SUBJECT: Consider Awarding Bid for Repainting
of WWTP Building
Issue
On Thursday, June 15, I received a call from Mr. Bill Chang regarding a bid
withdrawal on the above item. Mr. Chang was contacted by Rainbow, Inc.,
who informed him they had misinterpreted the bidding documents and
underestimated the project cost. Rainbow, Inc., requested to withdraw their
original bid and resubmit a bid based on a different paint system.
As Pat Klaers and Darrell Mack were out on vacation Thursday and Friday,
Mr. Chang asked that I include the recent correspondence from Rainbow,
Inc., with the original documents he had submitted for the agenda packet. As
indicated by Mr. Chang, Darrell Mack will need to evaluate the paint system
suggested by the contractor.

Action Requested
Mr. Chang has indicated that if the paint system is accepted by Darrell
Mack, the City Council could retain the contractor's bid bond and re-advertise
the project, or accept the contractor's suggested paint system by way of a
change order.

Dear Mr. Klaers:
We have been working with the wastewater treatment facility operator to improve the
awLENCINEERwc exterior coatings on the buildings at the treatment facility. The coatings were applied to
ENYIRONMENiAL three buildings during the 1978 plant expansion and, over the years, the coatings have
MUNICIPAL deteriorated to a point that is threatening the integrity of the masonry structures. In order

Rainbow, Inc., is the low bidder. We have had some previous experience with this
contractor on a water tower refurbishing project. The work they performed was
satisfactory. Based on our experience and the quotes received, we recommend the City
award the project to Rainbow, Inc., at the next Council meeting. The specifications require
OFFICES IN: completion of the work within 90 days following the notice-to-proceed.

On June 2, 1995, I sent a letter to Mr. Fat Klaers recommending the City awazd the
referenced project to Rainbow, Inc. This recommendation has been included in the agenda
for the June 19th Council melting. Rainbow, Inc., however, has advised us in a letter
dated June 14, 1995 (attached} that they have misinterpreted the bidding documents and
