Issue
Kraus-Anderson of Elk River, Inc. is requesting a conditional use permit for a
site plan review to construct approximately a 6,000 square foot building for
Video Update.
Location
• Lot 2, Block 4, Elk Park Center (lying between Highway 169 and Freeport
Avenue immediately south of the new First National Bank building.

Overview
The Elk Park Center Planned Unit Development requires a conditional use
permit for all new construction. Therefore, Kraus-Anderson is requesting a
conditional use permit allowing for the construction of a 6,000 square foot
building which is intended to be occupied by Video Update. The proposed
building would be located between Highway 169 and Freeport Avenue on one
of the free-standing lots. Approval for the construction of this 6,000 square
• foot building would be the last lot along Freeport and Highway 169. Other

businesses along this stretch from north to south include Wendy's, First
National Bank, and Taco Bell.
• Site Plan Review
In the attached report to the Planning Commission, staff has compiled a list
of specific comments relative to reviewing the site plan for the proposed
Video Update. Since the Planning Commission meeting, Kraus-Anderson
has worked with their architects and engineers to address staffs and the City
Engineer's comments outlined in the 'report to the Planning Commission
dated May 23, 1995.
The following is a summary of how Kraus-Anderson has addressed staffs
comments:
• Parking and Circulation -The plans have been revised to address all four
conditions including the removal of the two parking stalls closest to
Freeport Avenue.
• Landscaping -The proposed landscaping plan has been revised in a
manner which takes into consideration the proposed landscaping on each
of the adjacent lots. Furthermore, the minimum requirements have been
addressed by oversizing a certain number of trees, in exchange for a slight
• reduction in the quantity of trees on the site.
• Building Elevations -The architects working on this project have been
able to incorporate a brick material throughout the building which will
provide the complimentary architectural element found throughout the
Elk Park Center Planned Unit Development.
PlanninP Commission Recommendation
The Planning Commission recommended approval of the proposed 6,000
square foot building for Video Update based on the conditions outlined in
staffs report dated May 23, 1995.
Recommendation
It is recommended that the City Council approve the conditional use permit
request by Kraus-Anderson of Elk River, Inc. to construct a 6,000 square foot
commercial building to be occupied by Video Update with the following
conditions:

Overview

The specific parcel will be the last free-standing lot along Highway 169 to be
developed. The proposed site is located between the First National Bank and
• the Taco Bell, which recently began construction. The proposed development
will have to comply with all of the standards approved as part of the Elk Park
Center Planned Unit Development.
Site Plan Review
The following is a list of comments based on the proposed development plans
submitted by Kraus-Anderson:
A. Site Plan
1. The proposed building location and parking lot construction
meet all of the required setbacks for the Planned Unit
Development.
B. Parkine and Circulation
1. Based on the proposed use as a Video Update, the number of
parking stalls provided will easily meet the City's parking
b requirements. This type of use would require one space for
- every two hundred square feet of building area. Therefore, 30
• stalls are required and the plans show 55.
2. All parking areas are shown on the plans as having concrete
curb and gutter. This improvement is in conformance with the
standards required for Elk Park Center.
3. A valley gutter section shall be provided through the driveway
in Freeport Avenue. This is necessary to continue the street
drainage to the next available catch basin in Freeport Avenue.
4. With there being additional parking stalls to serve the business,
it would be recommended to eliminate the two parking stalls
closest to Freeport Avenue. By doing this, it allows a vehicle to
pull completely off Freeport and wait for the vehicle to leave
that particular stall. Generally, the traffic movements at the
entrance would be less congested.
C. Landscauine
1. The City's landscaping requirements are based on the
perimeter distance of the subject property divided by 40. Based

i on this formula, the proposed development would be required
to have 19 trees. This total number is then broken into three
. classifications; overstory, ornamental, and conifer trees. Staff
would recommend that the proposed plan be modified to be in
conformance with the City's landscaping requirements.
2. The proposed landscaping at the entrance drive off of Freeport
Avenue should be properly located and sized to prevent the
obstruction of visibility of vehicles both entering and leaving the
site.
3. The proposed landscaping plan should be designed with
consideration given to the adjoining projects' plans that have
been approved.
4. As part of previous three plans that have been
approved along Highway 169, some medium size shrubs and
ornamental trees have been included along the Highway 169
frontage. This same type of landscaping improvement should
also be included on the proposed development.
5. All disturbed areas shall be sodded and irrigated as set forth in
the PUD requirements.
• D. Pedestrian Circulation
1. The proposed plans include a 6 foot wide sidewalk extending to
sidewalk along Freeport Avenue. This improvement is
consistent with other developments in Elk Park Center which
encourages pedestrian traffic throughout the project.
E. Refuse Collection
The enclosure shall be designed with a masonry material that
will complement the building.
2. The location of the trash enclosure should be positioned on the
site to allow easy accessibility and minimize its visual
appearance from Highway 169.
It is also recommended that the enclosure itself be designed to
provide easy accessibility for delivering refuse to the enclosure.
This is often accomplished by providing an entrance that can be
used without having to open the enclosure's gates.

F. Drainage and Utilities
• 1. Refer to the City Engineer's memo dated May 17, 1995 for
additional comments.
2. Appropriate erosion control shall be utilized during construction.
G. Building Elevations
The proposed building consists of a decorative rock-faced block along
with accent bands of smooth concrete block. Video Update's color
scheme is primarily a white building v~ith red accent bands. The
Planning Commission may recall one of the elements in the Planned
Unit Development was to maintain some architectural consistency
throughout the development. One of the prominent building materials
used on the Target building and each of the multi-tenant buildings
(Buildings B and C) on each side of Target is a brick material. This
same material has been incorporated into a couple of the free-standing
buildings (First National Bank and Wendy's). This brick material has
not only provided some consistency in the type of masonry material use
in the development, but also maintained the earthtone color scheme.
• Staff would suggest the proposed Video Update building accomplish
one of the following two:
• The proposed color scheme be modified to be more consistent with
the predominant earthtone colors that are being used throughout
the development; or,
Incorporate a similar brick material providing the continuity
discussed in the planned unit development agreement.
H. Signage
1. Attached is a proposed monument-style sign for Video Update.
This particular sign design is consistent with the planned unit
development agreement for Elk Park Center and is the same
type of sign that has been approved with other free-standing
sites in the development.

throughout the development. Once again, this a common design
feature that was approved as part of the planned unit
• development agreement.
Recommend¢tion
It is recommended that the Planning Commission recommend approval of the
conditional use permit request by Kraus-Anderson of Elk River, Inc., allowing
construction of a 6,000 square foot commercial building for Video Update
with the following conditions:
1. All comments stated within this memo and those included in the City
Engineer's memo dated May 17, 1995, being incorporated into the
proposed development plans.
2. Three sets of revised plans be submitted for approval prior to issuance
of a building permit.

RE: VIDEO UPDATE SITE PLAN REVIEW
Dear Mr. Ach:
As you requested, we have reviewed the site plan submittal information for the proposed
Video Update facility in the Elk Park Center. Based on our review, we would offer the
following comments.
1. The grading of the site indicates that all surface drainage would be conveyed
directly onto Freeport Avenue. This is not an acceptable situation. Catchbasins
should be constructed internal to the site with all surface drainage picked up prior
to discharge onto Freeport Avenue. The grades at the driveway should be adjusted
slightly to create a high point such that overland flow from the site onto Freeport
is eliminated.
2. The Fire Chief has reviewed the spacing of the fire hydrants on Freeport Avenue
and indicates that these are adequate to provide fire protection to the proposed
facility.
3. The trash receptacle area located just off the southeast corner of the building will
be very difficult for a lazge garbage truck to access. We would recommend that this
location be reconsidered and designed in such a way that access is much easier.
4. The grading on the south side of the building indicates a swale for overland flow
towazd the west at a 0.66% grade. We would recommend that this Swale be graded
to a minimum of 1% to ensure adequate drainage from this area. Drainage along
the south side of the building also needs to consider the north side of the lot
adjacent to Video Update. There is no information provided on the grading plan
relative to drainage in this azea. This needs to be added and considered in the
overall drainage of the two areas. Perhaps a Swale located along the lot line
between the two would be a reasonable solution to drainage in this entire area.

5. As the driveway opening is cut into the site, pedestrian ramps will need to be
provided on both the north and south side for continuation of the sidewalk through
the driveway opening.
6. There is a spot elevation just to the north of the driveway opening which appears
to be erroneous. It is listed as 936.51. It appeazs this should be 934.51.
7. The sign location shown on the site and grading plan does not match with the
landscape plan. However, we understand that the future pazking area is proposed
to be built immediately which would tend to follow the layout shown on the
landscaping plan.
