Location • South end of the Planned Unit Development between Target and Freeport Avenue. Zoning/L¢nd Use PUD (Planned Unit Development) / HB (Highway Business) Attachments • Staff report to the Planning Commission dated May 23, 1995 Overview The proposed 16,000 square foot multi-tenant retail building was not included in the first phase of Elk Park Center's development plans. Therefore, similar to the free-standing sites on the east side of Freeport Avenue, a conditional use permit is required prior to commencing construction of the building. The building as proposed is consistent with the overall master development plan that was approved by the City Council for. the entire Elk Park Center Planned Unit Development. This building is referred to as Building E and is designed with approximately 9 individual . bays that are smaller than those found in Buildings B and C, located on each 13065 Orono Parkway • P.O. Each of the bays are approximately 50 feet in depth with varying widths of 20 to 40 feet. All of the parking and utility improvements have already been completed with the construction of Target and Buildings B and C. Since most of these exterior improvements have already been completed and reviewed by staff, there are less issues associated with the construction of the 16,000 square foot building. However, in the attached report to the Planning Commission dated May 23, 1995, staff has outlined a few issues which will need to be addressed and incorporated into the revised development plans prior to issuance of a building permit. Sign¢ge One of the issues associated with this proposed building as well as the smaller bays in Buildings B and C is the allowable wall signage. The current requirements for signage as incorporated into the planned unit development agreement establishes a "sign setback" of 3 `4" from the outer lease limits (wall). Typically, this outer limit happens to be a brick column; however, with the narrower bays this setback has a tendency to allow less flexibility in accomplishing the tenants signage demands. Kraus-Anderson is proposing to deviate from the current sign setback • requirements for all those multa-tenant bays that have a width of 20 feet. The sign setback of 3'4" will still be maintained from each of the brick columns, however, will be reduced to 2' from the common wall dividing the tenant spaces within the columns. Staff believes allowing the reduction in the setback for the smaller bays will not destroy the integrity or intent of the signage requirements for the planned unit development; therefore, would support Kraus-Anderson's request. Planning Commission Recommendation The Planning Commission recommended approving the conditional use permit for Kraus-Anderson to allow construction of the 16,000 square foot building based on the conditions outlined in staffs memo dated May 23, 1995. In addition, the Planning Commission agreed to have the planned unit development agreement amended to allow the change in signage requirements for all multi-tenant bays in Buildings B, C and E, allowing a 2' sign setback from the common wall between tenant spaces. • s:~~~,a~:~sa-z CU 95-7 memo continued ... Recommendation Page 3 • It is recommended that the City Council approve the conditional use permit request by Kraus-Anderson of Elk River, Inc. to allow construction of a 16,000 square foot multi-tenant retail store as part of Elk Park Center Planned Unit Development with the following conditions: 1. All comments outlined in staff's memo dated May 23, 1995 be incorporated into the revised development plans. 2. The planned unit development agreement be amended to allow the proposed change in sign requirements for those multi-tenant bays with a width of 20 feet. 3. ZONING/LAND USE PUD (Planned Unit Development)!HB (Highway Business). • Location map • Zoning map • Development plans OVERVIEW The Elk Pazk Center planned unit development has been designed to require each new development to obtain a conditional use permit prior to commencing construction. The proposed 16,000 square foot multi-tenant retail building was not included in the first phase of Elk Park Center development plans. Therefore, similaz to the freestanding sites on the east side of Freeport Avenue, a conditional use permit is required prior to commencing construction. The proposed building was approved as part of the overall master development plan for the entire Elk Park Center planned unit development. Box 490 • Elk River, MN 55330 • (612) 441-7420 • Fax: (612) 441-7425 Building `E' is designed with approximately nine individual bays that aze smaller than those found in Buildings `B' and `C' located on each side of the Target store. Each of the bays are 50' in depth with varying widths of 20' to 40'. A majority of the improvements to serve the new building, such as the parking and utilities have already been installed as part of Phase I. However, there will need to be some minor improvements along with the construction of the 16,000 square foot building. The following is a list of comments from staff regarding the proposed 16,000 square foot building. 1. The service drive on the south side of the building will have to be properly signed to prevent parking from occurring. This driveway is approximately twenty feet in width--since this is primarily a "service drive" the narrow drive should not be a problem. 2. The plans indicate that all pazking areas will be bounded with concrete curb and gutter, which is consistent with the standards outlined for the Elk Park `~ Center Development. 3. The required parking for this building was determined when the master development plan was approved. • Refuse Collection The plans indicate that both trash enclosures will be constructed of a masonry material, which compliments the 16,000 squaze foot building. Staff recommends that these enclosures be lazge enough to accommodate general trash collection, as well as recyclable materials. 2. Enclosures shall be properly screened with appropriate landscaping. 3. Consideration should be given to designing the enclosures with convenient and easy pedestrian access. i e Attached is a proposed signage package for "Building E". This package is consistent with the Elk Pazk Center PUD agreement with the exception of the 20 foot wide bays. • s:planning:pc:cu95-07 The current requirements establish a sign setback of 3'4" from the outer lease limits (wall). Typically, this "outer limit" happens to be a brick column. • However, with smaller bays there is now the opportunity to create two tenant spaces within each column. The proposed deviation from the current requirements is the sign setback from the common wall within the columns. It is requested the sign setback be scaled back to 2 feet. The overall squaze footage will not change; rather, it will allow flexibility with sign location and style of sign. It is staff s understanding Kraus-Anderson would like to utilize this same standazd on Building B and C when necessary. Site Plan 1. The new retaining wall on the south side of the service drive should consist of a similar block material used on the retaining walls south of Tazget. 2. It was not cleaz on the site plans how high this retaining wall would have to be. Therefore, a detail should be submitted along with the final set of plans. Attached, is a sign package proposed for building "E". This package is slightly different `' y~ than building's B and C. The primary difference occurs on the smaller signs where it becomes difficult to maintain 3' feet 4" inches from each edge of leased space. Staff will discuss this further at Tuesday's meeting. • Building rch't c ~*e The building materials appeaz to be similaz to Building B and C next to Target. This will strengthen the continuity of the project's design. RECOMMENDATION It is recommended the Planning Commission recommend approval of the conditional use permit for Kraus-Anderson of Elk River, Inc., allowing construction of a 16,000 square foot multi-tenant retail building in Elk Pazk Center Planned Unit Development, with the following conditions: Comments stated in the staff report dated May 23, 1995 being incorporated into revised set of plans and submitted for final approval prior to issuance of the building permit. • s:p] anning:pecu95-07 2.
