Dear Council Members:
As you directed, we have prepared the feasibility study for the 1995 Bituminous Overlay
Improvements. As you recall, this includes the areas of Greenhead Acres 1st, 2nd, and 3rd
Additions, Country Side Acres Addition, and the Avon Acres Area along east TH 10.
These areas have been recommended by Street Superintendent Phil Hals for a bituminous
overlay in 1995. It has been the City's practice to periodically undertake these types of
CIVIIENGINEERINCr improvements in an effort to rehabilitate existing streets before deterioration gets to the
ENVIRONMENTAL point that reconstruction is the only viable alternative. In accordance with the City's
MUNICIPAL Assessment Manual, it is proposed to assess 100% of the project costs to the benefitting
~NING properties on a per unit basis. We have analyzed the assessment rates on an azea by azea
I1D WASTE basis. This analysis indicated that each area would have approximately the same assessment
sreucnrRAL rate. Therefore, the feasibility study recommends aCity-wide assessment rate estimated

TRANSPORTATION The schedule presented in the feasibility study recommends a public hearing be held on
June 26. It also suggests proceeding with plans and specifications at this time to expedite

• A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE
IMPROVEMENT IN THE MATTER OF THE
1995 BTI'UMINOUS OVERLAY IMPROVEMENT
WHEREAS the Feasibility Report ordered by the CouncIl in Resolution 95-22 has been
prepared with reference to the 1995 Bituminous Overlay improvement and was
received by the City on June 5th, 1995; and
WHEREAS the Feasibility Report recommends that the proposed improvement is feasible;
NOW, THEREFORE, BE IT RESOLVED 6y the City Council of the City of Elk River,
Minnesota:
1. The City Council will consider the 1995 Bituminous Overlay improvement as described
in the Feasibility Report and the assessment of the property abutting this proposed
improvement for all or a portion of the cost of the improvement pursuant to Minnesota
• Statutes, Section 429 at an estimated total cost for the improvement of $265,800.
2. A public hearing shall be held before the City Council on the proposed improvement on
the 26th day of June, 1995, at 7:00 o'clock p.m., at the Elk River City Council Chambers.
3. The City Administrator shall provide ten days mailed notice and two weeks published
notice on the hearing as required by law.

• A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE
PREPARATION OF PLANS AND SPECIFICATIONS IN
THE MATTER OF THE 1995 BITUMINOUS OVERLAY IMPROVEMENT
WHEREAS a public hearing relating to the 1995 Bituminous Overlay improvement will be held
before the Elk River City Council after ten days mailed notice and two weeks
published notice of the hearing was given; and
WHEREAS the City Council has duly considered the Feasibility Report; and
WHEREAS the City Council desires to possibly expedite the project schedule pending matters
presented at the public hearing;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
• 1. M5A, Consulting Engineers is hereby designated as Project Engineer for this improvement.
The Project Engineer is directed to prepare plans and specifications for the making of the
improvement and the solicitation of competitive bids.
