Dear Mr. Klaers: '
Now that the Developers of Outlot A, Deerfield Third Addition have indicated in writing
their desire to have the intersection of Elk Hills Drive and Dodge improved along with
Dodge Street north to 159th, and have also indicated their willingness to escrow for the cost
of plans and specifications and accept assessments against their property in the amount of
$145,000, it would be appropriate for the City Council to make a final determination on
CIVIL ENGINEERING the intersection wnfiguration. As you recall, the last time the City Council considered this
ENwaoNMENTAL item, they delayed a decision on the intersection configuration pending either a petition
MuwcIPAL from the property owners to the south or an indication of a development moving forward

srRLxTORAL The feasibility study for these improvements outlined two options for the improvement of
SURVEYING the Elk Hills Drive/Dodge intersection. The first one referred to on Figure 8 in the
TRAFFIC feasibility study was the curved alternative, and the second one shown on Exhibit 8-a in the
TRANSVORTnnaa feasibility study was a 4-legged intersection. The City Council has discussed the pros and
cons of both of these alternatives on several occasions, most recently at the April 3rd City
ELECFRICAL/MECHANICAL
ENGINEERING: COU11C11 meeting. It appeared that there was a consensus of the City Council leaning
HYAC toward the 4-legged intersection. Attached for consideration by you and the City Council
EOwER DISTRI6unoN are two larger scale drawings showing more detail of both of these alternatives.

srsrEMcoNreoLS Since the preparation of the feasibility study, we have had an opportunity to review these
in greater detail. You will note that the 4-legged intersection has now been shown moved
slightly farther to the east. This allows for greater stacking between TH 169 and Dodge.
It also provides for a more defined lane for eastbound Elk Hills Drive traffic wanting to
turn left to northbound Dodge. Based on all of our previous discussions with the City
Council and the information obtained from the public at the informational hearings and City
Council meetings, I would recommend that the City Council pursue the 4-legged
intersection alternative. As I've indicated before, neither of these two options are a perfect
solution to the traffic problems now and projected for the intersection of Elk Hills Drive
PPICESIN: and Dodge. I believe the 4-legged intersection provides for the best solution, given the
MINNEAPOLIS constraints of the physical parameters in the area.

I will be prepared at the June 5th Ciry Council meeting to answer any Council questions
regarding these alternatives or to provide backup information from our previous discussions
with the City Council. After Council consideration and direction on the alternative for the
improvement of the intersection, it would be appropriate for the City Council to consider
the attached resolution which authorizes the preparation of plans and specifications. I have
structured the resolution such that the authorization for plans and specifications only deals
with the intersection, necessary improvements to Dodge Avenue to the south, and the
improvement to Dodge Street north to 189th.

meeting on June 5th, please call.

• A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE IMPROVEMENT AND
PREPARATION OF PLANS AND SPECIFICATIONS
IN THE MATTER OF THE
ELK HILLS DRIVE AND DODGE IMPROVEMENT
OF 1995
WHEREAS, the Developers of Outlot A Deerfield Third Addition have requested the
initiation of the preparation of plans and specifications and aze willing to
escrow for the cost of such; and
WHEREAS, the Developers have indicated their willingness to accept assessments against
Outlot A Deerfield Third Addition for their fair shaze; and
WHEREAS, the City Council has duly considered the Feasibility Report;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
• Minnesota:
1. MSA, Consulting Engineers is hereby designated as Project Engineer for this
improvement. The Project Engineer is directed to prepare plans and specifications
for the making of the improvement and the solicitation of competitive bids.

RE: E!k River Development Corporation Project
Northeast Corner of Elk Hills Drive and U.S. Highway 169
Dear Mr. Klaers,
This letter will confirm our recent discussion regarding our request !flat the City of Elk River
authorize its consulting engineers (MSA Consulting Engineers) to commence to prepare plans
and specifications for the revision to intersection of Elk Hills Drive and Dodge Street as well as
the revisions to Dodge Street extending from said intersection to 189th Avenue. It is further
understood that said intersection will be designed as a "four legged T" substantially similar to
Exhibit 8A of the MSA report dated ]anuary 18, 1995. Elk River Development Corporation
agrees that on or about Lune 5, 1995 it will provide a letter of credit issued by Norwest Bank
Minnesota as surety that it will pay for the cost of preparation of said plans and specifications.
• The letter of credit will be in the amount of $22,500.00.
Elk River Development Corporation agrees to provide the letter of credit with the additional
understanding that the preparation of the plans and specifications will be completed by a date
that will allow for bidding, the letting of contracts and commencement of construction of said
roadwork by the day after the first Council meeting of September, 1995.
The above defined terms and conditions are conditioned upon the City and the developer
reaching agreement on the portion of the cost of construction that shall be the responsibility of
tl7e developer (Elk River Development Corporation). The proposed developer's portion is set
forth in a letter to the City of Elk River also dated May 31, I995.
This letter is respectfully submitted in behalf of Elk River Development Corporation by its
consultant, Bruce A. Peterson.
