TO: Mayor & City Council FROM: Pat Klaers, City Administrator DATE: July 17, 1995 SUBJECT: Water Restriction Ordinance During the hot summer season of 1988, the City Council called for a voluntary watering ban. The City has not had a need for such a watering ban since that time. With the current heat wave that the state is experiencing, many cities are being forced into water restrictions in order to ensure that adequate water is available to fight fires. Once our two new wells and towers in the northeast and west are on line, we don't believe that we will need any watering • .restrictions in the foreseeable future. However, weather in Minnesota is unpredictable and the need may arise at some time in the future, or even in later 1995. The Elk River Municipal Utilities Commission has passed a motion that requests the city to adopt an ordinance that allows for the Utilities Commission to order watering restrictions if necessary. The model that is being looked at is the one that is in effect in the City of Anoka. Once watering restrictions are ordered, the city would have to publicize this fact through the Twin Cities newspapers and radio and T.V. stations like all other metropolitan communities currently do when the situation arises. Attached for your consideration is an ordinance as prepared by the City Attorney which allows for the watering restrictions under certain conditions. n U 13065 Orono Parkway • P.O. The Council, by Resoluta.on, may order that during anytime between June 1 and August 31 of each year, lawn and garden sprinkling, including the use of irrigation systems and the watering of trees and shrubs, using City supplied water, shall be permitted only as follows: (a) Except for hand watering, as permitted in'subsection (b), properties having odd-numbered mailing addresses may be watered only on odd-numbered days and properties having even-numbered mailing addresses may be watered only on even-numbered days. (b) Hand watering, either with a hose or with a container, shall be permitted at any time unless specifically restricted by further order. Section Additional Restrictions. Upon the advice of the Elk River Utilities Manager that further watering restrictions are necessary to protect water reserves, the Council, by resolution, may order the following additional restrictions, which shall take effect immediately upon publication: ' (a) In addition to the restrictions contained in Section , the Council may ban all watering with City supplied water, • including or excluding hand watering by hose, between the hours of 10:00. A.M. and 8:00 P.M.; (b) The City Council. may impose a total ban on watering with .City supplied water upon a finding that such ban is necessary to protect the public's health, safety and/or welfare.. Section Penalties. The person in whose name the account for City water is kept by the Elk River Utilities for each property within the City shall be responsible to maintain compliance with on such property. Upon any violation of the restrictions imposed by the Elk River Utilities may shut off water service to the subject property and service shall be restored when the standard reconnection charges-.are paid. , • C RESOLUTION N0. RESOLUTION IMPOSING WATERING RESTRICTIONS WHEREAS, the Elk River City Council has adopted Ordinance which provides for restrictions on lawn and garden Sprinkling, including the use of irrigation systems and the watering of trees and _shrubs'using City supplied water, but not including hand watering, either with a hose or with a container, in the City of Elk River. WHEREAS, Certain restrictions may be imposed by Resolution of the Elk River City Council; and WHEREAS, due to dry conditions and high demands on the municipal water supply system, and based upon advice from the Elk River Utilities Manager and the Water Superintendent that restrictions on lawn and garden sprinkling are necessary to protect the public safety and insure that adequate supplies of water will be available in the event of f ire . ~• NOW, THEREFORE, IT IS~ HEREBY RESOLVED by the Elk River City Council that the restrictions allowed by Section which limits watering, except for hand watering, to odd-numbered days for properties having odd-numbered mailing addresses and limits watering, except for had watering, to even-numbered days for properties having even-numbered mailing addresses, and Section which further limits all watering, except hand watering, between the hours of 10:00 A.M. and 8:00 P.M. of the Elk River City Code are hereby ordered, effective .and said restriction shall continue until or until further order of the City Council.
