Background
Mr. Colbath is requesting a Conditional Use Permit to operate an Upholstery
Business from his home located at 13155 - 183rd Avenue, Elk River,
Minnesota. The applicant currently operates an Upholstery Business in New
Hope, and if approved would move the business to his home in Elk River.
The reason that this item is required to go through a Conditional Use Permit
is that some of the equipment, such as industrial sewing machines, are not
normally found in a home.
Business
The business will consist of primarily residential re-upholstery and some
small scale commercial re-upholstery. The proposed business would also
• consist of making custom boat covers. This would require that the customer's

boat would remain on-site until the cover could be fitted. The applicant is
proposing no outdoor storage related to the business, with the exception of
the occasional customers boat.
The business is proposed to be operated out of the applicant's attached 24' x
24' garage. If this application is approved, the applicant plans on adding a
19' x 30' addition to the existing garage. The proposed garage addition would
meet the accessory structure ordinance in terms of accessory structure area.
The applicant is proposing that all sales be conducted at the customers home
or business, with the applicant providing pick-up and delivery of all
merchandise. Therefore, customer traffic would be kept to a minimum. The
applicant does anticipate UPS deliveries of fabric and supplies a couple of
times a week. The specifics of this request are included in the attached
Memo to the Planning Commision.
Planning Commision Meeting
At the June 27, 1995, Planning Commision Meeting, the Commision
concurred with staffs findings, and recommended approval of the
Conditional Use Permit to operate an Upolstery Business from the
applicant's attached garage.
• Recommendations
Staff and the Planning Commision feel this request meets the seven
standards for a Conditional Use Permit as outlined in Section 900.20 of the
Elk River City Code of Ordinances, as well as the Home Occupation
Ordinance. Staff and the Planning Commision are recommending approval
of the Conditional Use Permit request to operate an Upholstery Business out
of the applicant's home, with the following conditions:
1. Hours of operation be from 7 AM to 10 PM, as per city code.
2. No exterior storage related to this business shall be allowed, with the
exception of one customer's boat being allowed to be kept in the
driveway at any one time.
3. Signage be limited to two square feet, and mounted flat on the wall of
the dwelling.
4. A maximum of one full-time employee, or equivalent, other than those
persons who customarily reside on the premises, shall be employed.
5. If valid complaints are received, this item will be brought back before
the Planning Commission and City Council for review.

The business will consist of the applicant, his wife, and one part time
employee. Hours of operation would consist of 7:00 a.m. to ?:00 p.m., Monday
through Friday, and occasionally on Saturday. Both of these standards
would meet the requirements established in the home occupation ordinance.
• Equ~ment
The applicant has indicated that the machinery needed to operate an
upholstery business consists of a compressor,. industrial sewing machines,
table saw, and band saw. The sewing machine and compressor are the
primary tools used extensively, with the saws used sparingly, for repair of
damaged furniture. The applicant has indicated that he plans on keeping the
air compressor in his basement, with airlines connecting to the garage. This
should aid in reducing noise from the business. The garage is also proposed
to be insulated, to help reduce noise. -
Previous Fl'ome Occupation
In 1993, the City of Elk River approved a similar home occupation upholstery
business for Todd Altenweg, at 11925 191st Avenue. The City's Planning and
Zoning Departments have not received any complaints on the business.
Recommendation

I currently operate my upholstery business in New Hope. It is my intention, if approved,
to move the business to my home at 13155 183rd Avenue NW in-Elk River.
My main business consists of residential reupholsterv-and some small scale commercial
reupholstery. I also make custom boat covers, in season. For this I would need to have
the customer's beat in my driveway for a day or t~vo while I fit it. Other than that, the
business would be completely contained in my garage, with an office in the house.
The only machinery needed to run my business are a compressor, industrial sewing
machines, a table saw and-a band saw. The compressor and sewing machines are used
the majority of the time. The saws are only used occasionally, to replace bad parts on the
furniture. I plan to keep the compressor in my basement with air lines running up to the
garage. I would insulate the garage for energy efficienc}~, as well as to cut down on any
• noise.
My existing attached garage is 24' x 24'. I would need to add on to it in order to have
enough room to operate. I anticipate an addition that would bring the total square
footage up to 1200 sq. ft. There would be no exterior. storage of related materials.
I do not anticipate much traffic to my home. I plan to make all sales in the customer`s
home or business. I would also pick up and deliver all the furniture. I would probably
have UPS de}iveries of fabric and supplies a few times a week.
I plan to operate the business with my wife, Cheryl, and probably one other part-time
.employee. My business hours would be approximately 7:00 a.m. to 7:00 p.m. monday
through friday, with occasional limited hours on Saturdays.
At this time, I am not sure if I would need a sign. However, if I did decide to put one up,
it would be a small one to let delivery persons know ~~hich door to use. It would be
under 2' x 2' and would be located near the man door to the >;ara~e.
