SUBJECT: Request to Vacate Street, Drainage, and Utility
Easements by Elk River Development
Corporation, Public Hearing Case No. EV 95-5
Issue
Consider Resolution 9S- vacating street, drainage, and utility easements within a
portion of Dodge Street, immediately north of Elk Hills Drive.

Overview
In order for the proposed commercial development to proceed forward on Outlot A of
Deerfield 3rd Addition, road improvements to Dodge Street and Elk Hills Drive will
need to occur. The intersection design of Elk Hills Drive and Dodge Street will resemble
a "T intersection", as presented by the City Engineer, Terry Maurer. This T intersection
will require Dodge Street, north of Elk Hills Drive, to be shifted further to the east than
its current alignment. By shifting Dodge Street further to the east, "extra" right-of--way
will be left on the west side of Dodge Street.
The developers of the proposed Elk River Retail Center are requesting that this portion of
additional right-of--way, which lies outside of any proposed improvements to Dodge
Street, be vacated and made part of the proposed plat and development plans. At this
point it is not clear what portion of Dodge Street will actually be vacated since the
improvement plans for Dodge Street are not completed by the City Engineers Office.
Once these plans are completed the exact amount of right-of--way necessary for the
proposed improvements will be determined, and the remaining right-of--way is the area
that can be vacated. The attached drawing, illustrating proposed right-of--way to be
vacated, is a fair representation of right-of--way expected to be vacated.

It is recommended that the City Council approve Resolution 95- , vacating a portion
of dedicated right-of--way for Dodge Street immediately north of Elk Hills Drive, with
the following conditions:
The exact area to be vacated be based on the final road improvement plans for
Dodge Street as prepared by the City Engineer.

. RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING STREET, DRAINAGE, AND UTILITY
EASEMENTS
CASE NO. EV 95-5
WHEREAS, a majority of the property owners abutting the street, drainage, and
utility easement have requested the City Council in a petition dated
June 19, 1995, to vacate such easement according to law; and,
WHEREAS, a public hearing was held on July 17, 1995, before the City Council
at the Elk River City Hall on such petition after due published and
posted notice had been given as well as personal notice to affected
property owners on July 3, 1995, and all persons interested were
given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
• the street, drainage, and utility easement described in Exhibit A is
hereby vacated with the following conditions stated below:
1. The area to be vacated shall be based on and consistent
with the improvement plans for Dodge Street prepared by
the City Engineer.
