SUBJECT: Easement Vacation of a Portion
of 221st Avenue; EV 95-6
As the council will recall, 221st Avenue west of Highway 169 and east of the
city's hiking trail, was recently realigned. The project started in the fall of
1994 and was completed in the spring of 1995. This realignment was
initiated by the city to remove the dangerous curves from this section of road.
On the attached map, the solid lines show the original layout of 221st
Avenue. The dash lines show the realignment of this street. Part of the
city's agreement with the adjacent property owners to gain the necessary
easements for the new alignment, was that the city would vacate the original
alignment.
The issue in front of the council is the vacation of the original alignment.
Attached to this memo, is a resolution that the City Council must pass to
accomplish this vacation. The property owners adjacent to this street are in
agreement with this request and staff recommends its approval.

RESOLUTION 95 -
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING STREET, DRAINAGE, AND UTILITY
EASEMENTS
WHEREAS, The City of Elk River has initiated a request to vacate a portion of
221st Avenue easement according to law; and,
WHEREAS, a public hearing was held on July 17, 1995, before the City Council
at the Elk River City Hall on such petition after due published and
posted notice had been given as well as personal notice to affected
property owners on June 22, 1995, and all persons interested were
given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the street, drainage, and utility easement described as follows is
hereby vacated with the following conditions stated below:
That part of 221st Avenue lying west of the westerly right-of-way of
US Trunk Highway 169 and east of the west line of the southeast
1 /4 of the southeast 1 /4 of Section 4, Township 33, Range 26,
Sherburne County, Minnesota.
Adopted by the Elk River City Council this 17th day of July, 1995.
