County Market Space in the Elk River
Mall

Consider granting a permit to Living Waters Church for temporary use of the
former County Market space to conduct a two week Evangelistic crusade.

Overview
Living Waters Church is planning on having atwo-week Evangelistic
crusade from August 18 through September 1st. The site they would like to
utilize is the former County Market space in Elk River Mall. During the two-
weekperiod, the meetings are expected to begin at 7 p.m. and end at
approximately 11 p.m. Approximately 1,500 chairs, a small stage and a
sound system will be set up to accommodate the meetings.
Former County Market Space
Approximately 36,000 square feet of space is available as a result of the
County Market leaving the Elk River Mall. A letter from Jack Sheedy, agent
for the Elk River Mall, has indicated the vacant space is in the process of
having leftover materials removed, cleaning the floors, walls, and lights to
make the space usable for this request, and hopefully, future tenants.
Upon receiving this application from Living Waters Church, the building

• to make sure the proposed use meets will all public safety concerns. Issues
such as occupant load of the available space, providing proper exiting from
the building, arrangement of chairs and proper lighting in case of an
emergency. At the time of preparing this memo, inspection of the space had
not been completed, however, if the Council approves this request, all
building and fire issues will have to be satisfied prior to occupying the space.
Parkin
The Elk River Mall currently has a parking lot with 848 parking stalls. The
two primary tenants include Pamida (55,000 square feet) and the Elk River
Theater (34,000 square feet and 1,700 seats). The City's parking
requirements for these two businesses alone would be:
• Pamida (1 per' 200 square feet) 275 stalls.
• Elk River Theater (1 per 3 seats) 566 stalls.
Total 841 stalls
Parking requirements for the proposed church use is also 1 space for every
three seats. Based on the proposed 1,500 seats, 500 parking stalls would
• then be required.
In summary, the parking requirements for the three primary uses at Elk
River Mall (Pamida, theater and church) would require a total of 1,341
parking stalls. This is 493 spaces more than currently exists. Since this is a
temporary use, the City Council could consider two options to address the
parking shortage:
1) Have staff monitor the parking on a daily basis, and have the church
submit an action plan that can be implemented if parking problems
occur.
2) Reduce the amount of available seating at the proposed crusade,
therefore, reducing the parking needs.
Hours of Operation
The proposed hours of the crusade is from 7 p.m. and ending at
approximately 11 p.m. for each day during the two-week period. Most
businesses within the mall close between 9:00 and 9:30 p.m. with the
exception of the theater. The last movie of the evening typically lets out
between 11 and 12 p.m. each night.

Conclusion
This is a temporary use that has two principle issues:
1) Building and fire codes being met prior to occupying the available
space
2) Providing adequate parking to avoid participants parking in adjacent
neighborhoods.
If these two concerns can be addressed, staff believes the proposed crusade
can be approved.
Recommendation
It is recommended that the City Council consider approving Living Waters
Church request to conduct atwo-week evangelistic crusade within the former
County Market space with the following conditions:
The building official and fire chief inspect the space to be utilized and
approve all public safety issues prior to occupancy.
2. The available seating associated with the crusade have a maximum of
1,000 seats, rather than the 1,500 requested.
3. An action plan be submitted outlining how potential parking problems
will be addressed if they were to occur. Parking off the Elk River Mall
site shall constitute a "problem" upon which the action plan shall be
implemented.
4. Meetings shall not extend past 11 p.m. during the two week crusade.
5. Dates of the crusade be August 18 through September 1, 1995, as
outlined in Pastor Bob Pullar's letter dated June 28, 1995.
