Issue
Kraus-Anderson of Elk River, Inc. is requesting preliminary and final plat
approval to replat a portion of Elk Park Center Planned Unit Development.
Location

Overview
The subject property was originally platted with Elk Park Center and
consisted of three individual lots. Since the platting of those lots Kraus-
Anderson has received interest from various businesses for the use of the
north end of Elk Park Center. Apparently, the type of possible tenants would
require the replatting of the original three lots into two larger lots to
accommodate their building and parking demands.
The consolidating of these three lots and the resubdividing into two lots
would technically require only an administrative subdivision, which could be

• The consolidating of these three lots and the resubdividing into two lots
would technically require only an administrative subdivision, which could be
done with a metes and bounds description. However, Kraus-Anderson would
like to formally plat the property into a lot and block description to simplify
the legal descriptions as well as the documenting of drainage and utility
easements.
Preliminary and Final Plat
Recently the City Council approved the amended subdivision ordinance
which included a provision for the preliminary and final plat to be considered
by the City Council at the same meeting. The purpose of this provision was
to allow plat requests involving the replatting of existing lots or new plats
that have very few issues associated with them to be considered in a timely
manner. Staff believes the request by Kraus-Anderson would fall within
these guidelines and are therefore, requesting both preliminary and final plat
approval from the City Council.
Future Driveway
The original plat and concept plan for the subject property originally included
a central driveway to serve all three lots accessing Freeport Avenue at
approximately the mid-point of what is proposed to be Lot 2, Block 1. This
driveway was slightly off-set from the proposed driveway on the south side of
Freeport Avenue which provides access to the future grocery store and other
retail tenants. With the new plat, the access road will be shifted to the east
adjacent to Highway 169 and, once again, access onto Freeport Avenue at a
location that provides greater separation between any access point into the
main portion of Elk Park Center. The City Engineer has reviewed this new
access point and believes there will be no problem with this new location; in
fact, the location may be better by providing greater separation to that access
road to the south of Freeport Avenue and reducing conflicting turning
movements.
Drainage and Utility Easement
The drainage and utility easement along the east side of Lot 1 may have to
be increased in width. This increased width may be necessary to allow the
extension of utilities to serve the city's property at Highway 169 and 193rd
Avenue. The City Engineer is researching the appropriate width that will be
needed to accomplish this extension.

A. It is recommended that the City Council approve the preliminary plat
request by Kraus-Anderson of Elk River, Inc. for Elk Park Center
Third Addition with the following conditions:
1) All easements be vacated from the previous plat and new
easements be established on the proposed plat, as recommended
by the City.
2) The final plat accurately reflects the necessary drainage and
utility easement along the east side of Lot 1, Block 1, to allow
the extension of utilities northward.
B. It is recommended that the City Council approve Resolution No. 95-
granting final plat approval for Kraus-Anderson of Elk River,
Inc. for Elk Park Center 3rd Addition.

Dear Mr. Ach:
As requested, I have reviewed the proposed replat entitled Elk Park Center Third Addition.
CIVIL ENGINEERING Based on my review, I would offer the following comments.
ENVIRONMENTAL
MUNICIPAL 1. This is a replat of the most northerly end of the Elk Park Center development.
""wc Originally, this was divided into three lots. It is now proposed to be replatted into

STRUCTURAL
SURVEYING 2. Originally, the road to serve this area was in the middle of what is now Lot 2. It
TRAFFIC is now proposed to be moved to the east edge of Lot 2. This is a much better
TRANSPORTATION location from a transportation standpoint because it moves it further away from the
Jackson Avenue intersection, and it also moves it further away from the access to
ELECTRICAL/MECHANICAL
ENCINEERINC: the Target lot to the south. However, services were stubbed out in the location
FIVAC originally planned; therefore, services will have to be re-established in the location
POWER DISTRIBUTION at the east end of the lot. This will require the cutting into Freeport Avenue to
scADA connect into manhole 16 and also to tap the water service.
SYSTEM CONTROLS
3. Depending on what type of business goes into the most northerly lot, Lot 1 of this
proposed replat, it may be advisable to loop the watermain through this area and
back to Freeport. Potentially, a building in this location would require a 6-inch
water service for sprinkling, but have a low domestic demand. This would cause
stagnant water and possibly complaints about discoloration and taste. By looping
the water, we should eliminate complaints and also provide a redundant service for
sprinkling or fire fighting. The exact location of the watermain loop could be
considered at the time of site plan review. However, easements will be needed for
oFFicES iN: purposes of this extension since it will be a public improvement. In fact, it would
~IINNEAPOLIS probably be possible to loop it back to its original intended location, which is in the
PRIOR LAKE center of Lot 2.

4. Provision should be made with this plat to provide sewer and water service
extensions underneath Jackson Avenue to the potential City lot to the north. As you
know, ultimately service to this area is intended to come around the north side of
St. Andrew's Cemetery near the intersection of Holt Avenue. However, it could
be some time until the City is prepared to authorize this extension of sewer and
water. In the meantime, it will be possible to jack individual services under Jackson
Avenue to provide service to one lot on the north side. In order to accomplish this,
a drainage and utility easement will be needed on the east side of Lot 1, Elk Park
Center Third Addition, to facilitate the extension of utilities up to Jackson Avenue
from where the services could be jacked under the road. The width of such an
easement would need to be approximately 30 to 40 feet. It is possible to get by
with less than this if they are pushed to the extreme east and a permit obtained from
the Highway Department for construction within the right-of--way.

RESOLUTION NO. 95 -
• CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
ELK PARK CENTER THIRD ADDITION
CASE NO. P 95-5
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, a preliminary plat of the Property was approved by the
City Council on August 3, 1995; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and. conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C. The physical characteristics of the site, including ,but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.

D. The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation,. erosion control and
all other services, facilities and improvements otherwise required
herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements. of record
or with easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse
impact on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
• 4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.
