SUBJECT: Summary Publication of Ordinance
95-15
INTROD UCTION
On July 24, 1995, the City Council adopted Ordinance 95-15, An Ordinance
amending section 1008 of the Subdivision Ordinance. To be valid, the city
must publish at least a summary of the ordinance in the official newspaper of
the city.
• BACKGROUND
If the City Council determines that publication of the title and a summary of
an ordinance would clearly inform the public of the intent and effect of the
ordinance, it may, by four-fifths vote, direct publication of only the title of the
ordinance and a summary. The publication must include a notice that a
printed copy of the ordinance is available for inspection at the office of the
City Clerk.
Due to the length of the recent adoption of the amended subdivision
ordinance, staff is suggesting publishing a summary of Ordinance 95-15.
ACTION REQUESTED:
Council motion adopting the attached Resolution approving notice of
summary publication of Ordinance 95-15.

A RESOLUTION OF THE CITY OF ELK RIVER
• A RESOLUTION APPROVING NOTICE OF SUMMARY
PUBLICATION OF ORDINANCE 95-15
AMENDING SECTION 1008 OF THE CITY OF ELK RIVER
SUBDIVISION ORDINANCE
WHEREAS, on July 24, 1995, Elk River City Council adopted Ordinance
95-15, amending Section 1008 of the Elk River City Code of
Ordinances titled, "Subdivision Ordinance."
WHEREAS, the amendment to the subdivision ordinance provides for
consistency with current operating procedures, minor format
changes and restructuring; adjustment of grammatical errors
and clarification of subdivision procedures and ~.nancing;
and
WHEREAS, the subdivision ordinance sets forth rules and regulations
governing plats and subdivision of land in the City of Elk
River. It is the purpose of these regulations to:
• 1. Provide for and guide the orderly, economic and safe
development of land and urban services and facilities.
2. Encourage well-planned, efficient, and attractive
subdivision by establishing adequate standards for design
and construction.
3. Facilitate adequate provision for streets, transportation,
water, sewage, storm drainage, schools, parks, playgrounds
and other public services and facilities.
4. Place the cost of improvements against those benefiting
from their construction.
5. Secure the rights of the public with respect to public
lands and waters.
6. Set the minimum requirements necessary to protect the
public health, safety, and general welfare;
and
WHEREAS, a copy of the full text of this ordinance amendment
(Ordinance 95-15) is available for inspection by any person
at the office of the Elk River City Clerk, 13065 Orono
Parkway, during regular business hours - 8:00 a.m. to 4:30
p.m., Monday through Friday; and
NOW THEREFORE BE IT RESOLVED, that the City Council, by at least
four-fifths vote, authorizes the publication of the title and
summary of ordinance 95-15; and
BE IT FURTHER RESOLVED, that Ordinance 95-15 shall become
effective upon publication of Resolution 95-_.
Passed and adopted by the Elk River City Council this 21st day of August,
1995.
