OVERVIEVV
The applicant is requesting an amendment to the Hillside Crossing PUD Agreement to
allow a third wall sign. There are currently two Harley-Davidson emblems on the
building and the applicant is asking for a sign that identifies the name of the dealership.
There is one emblem on the south side of the building and one on the west side. The
emblems are 9' X 12' and were approved in October 2000. The proposed dealership
sign would be over the entrance at the southwest corner of the building. The proposed
sign would be either be 10' X 12' or 10' X 14'. Both of the existing signs and the
proposed sign are internally illuminated.
Given the size and design of the building, the third wall sign would not be excessive. The
total signage for the building would be far under the 10% wall coverage allowed.
PLANNING COMMISSION MEETING
At the April 24th Planning Commission meeting no one spoke at the public hearing. The
Commission did not express ant concerns regarding the proposal and recommended
approval of the proposed third wall sign.
RECOMMENDATION
The Planning Commission and staff recommend that the City Council approve the
proposed amendment to the conditional use permit for the Hillside Crossing Planned
Unit Development to allow a third wall sign for Lot I, Block I Harley Addition with the
following condition:
I. A City of Elk River sign permit be obtained for the proposed wall sign.

Tenant Identification (Along Jackson)
1. A monument style sign may be located at the intersection of
Jackson Road and southernmost entrance to the project.
2. This sign shall have a maximum height of six (6) feet and a
width of four (4) feet.
3. The purpose for this sign is to identify the anchor tenant
(Targe!). located at the southerly end of the project.
4. Said sign shall be constructed in accordance with the
illustration on Attachment B.
Monument Sign For Freestanding Sites
1. Each of the freestanding buildings within EP,O.'will be
allowed to have a freestanding sign. The freestanding' sign must
be of a monument style with a maximum height of ten (10) feet and
a maximum area of one hundred (100) square feet.
2. Attachment C illustrates a typical monument sign for
freestanding buildings.
Wall Signs (Freestanding Sites)
1. Wall signage for each freestanding building must consist of
individual letters and shall not have more than one (1) wall sign for
each principal building except that where the building abuts two (2)
or more public streets.
2. The gross surface area of a wall sign for freestanding
buildings shall not exceed ten (10) percent of the area of the
building wall, including doors and windows, to which the sign is to
be affixed.

PLANNED UNIT DEVELOPMENT AGREEMENT
CITY OF ELK RIVER, SHERBURNE COUNTY, MINNESOTA
THIS AMENDMENT NO. I is made as of the ~ day of , 2001, by and
between the CITY OF ELK RIVER, Sherburne County, Minnesota (the City), and Phoenix
Enterprises, LLC.
WITNESSETH:
WHEREAS, on May 6, 1996, the City of Elk River and Elk River Development
Corporation hereto entered into Hillside Crossing II Planned Unit Development Agreement;
and
WHEREAS, during 1998, the Elk River City Council approved the further subdivisions of
the Property, said subdivision known as Harley Addition; and
WHEREAS, Phoenix Enterprises, LLC. owns Lots I, Block I of Harley Addition; and
WHEREAS, on May 21, 2001, the Elk River City Council approved an amendment to
allow a third wall sign on Lot I, Block I Harley Addition.
NOW, THEREFORE, it is hereby agreed by and between the parties here as follows:
I.) The Hillside Crossing II Planned Unit Development Agreement is hereby
amended to allow a third wall sign for the Zylstra Harley Davidson.
2.) The words, phrases, terms, and conditions used herein shall be interpreted the
same as those used in the Hillside Crossing II.
3.) All other terms and conditions of the Hillside Crossing II Planned Unit
Development Agreement, as amended, shall remain in full force and effect and shall be binding
upon the parties hereto, except to the extent clearly inconsistent with the terms and conditions
of this Amendment No. I.
IN WITNESS WHEREOF, the parties have caused this Amendment No. I to be duly
executed in their names and on their behalf on or as of the date first above written.
