97-024 ORDORDINANCE 97- 24 CITY OF ELK RIVER AN ORDINANCE AMENDING SECTION 900.12 OF THE CITY OF ELK RIVER CODES OF ORDINANCE RELATING TO PERMITTED AND CONDITIONAL USES IN THE BUSINESS PARK ZONING DISTRICT CASE NO. OA 97-12 The City Council of the City of Elk River does hereby ordain as follows: Section 1. Section 900.12 (16) of the City of Elk River Code of Ordinance titled "Permitted, Accessory, and Conditional Uses" is hereby amended to delete the Statement of Purpose and replace it with the following: Statement of Purpose: The Business Park district is established to encourage a planned, integrated environment for certain industrial, office and commercial uses which are compatible with and comphment each other as well as the surrounding land uses. The underlying land use designation will guide the type of uses allowed within the district. The underlying land use designation within the district may vary, either hght industrial or highway business. Development within the Business Park district will correspond with the land use designation. Industrial and office uses allowed where the land use designation is light industrial, and commercial uses allowed where the land use designation is highway business. It is the intent of this ordinance that development reflects common themes using compatible architectural design and consistency in signage, landscaping, and lighting. It is also the intent to encourage businesses which generate a high number of jobs per square foot rather that predominately warehouse types uses. Section 2. Section 900.12 (16) of the City of Elk River Code of Ordinance titled "Permitted, Accessory, and Conditional Uses" is hereby amended to delete the following: Section 900.12 (16) A. Permitted Uses Section 900.12 (16) C. Conditional Uses Section 3. Section 900.12 (16) of the City of Elk River Code of Ordinance titled "Permitted, Accessory, and Conditional Uses" is hereby amended to add the following: A. Permitted Uses i. Permitted uses allowed when the underlying land use is hght industrial: 1. Light manufacturing 2. Research and development laboratories 3. Government, business and professional offices 4. Mail order operations \\elkriver\sys\shrdoc\document\ordinanc\oa97.12.doc 5. Telecommunication operations Permitted uses allowed when the underlying land use is highway business: 1. Health athletic clubs 2. Personal service estabhshments 3. Financial institutions C. _Conditional Uses: Conditional uses allowed when the underlying land use is light industrial: 1. Any permitted use which involves more than 30 % warehouse space 2. Vocational, technical, and trade schools 3. Multiple buildings on a lot 4. Multiple tenant buildings 5. Above ground storage tanks ii. Conditional uses allowed when the underlying land use is highway business: 1. Hotels and motels 2. Licensed daycare facilities 3. Retail shops and stores which comphment and serve the Business Park subject to the standards set forth in 2(j) below 4. Motor vehicle specialty service stations 5. Multiple buildings on a lot 6. Multiple tenant buildings 7. Restaurants (Class I) Section 3. That this Ordinance shall take effect and be in full force from and after the date of its publication.
