Background/Discussion
Council completed a draft review of the 2010 fee schedule on October 19.
Council requested a clarification on the definition of SAC units for the City of Rogers when a
development fee comparison for surrounding communities was reviewed.
Following are comments from the economic development director:
"Rogers applies their SAC fees for Commercial/Industrial uses at a rate of $4,300 for the first
unit, lus $1,850 for each additional unit. Rogers specifically defines a unit of sewage volume as
100,000 gallons per year. In Elk River the units are established in the City's ordinance by
estimated usage and diffexent variables like square footage, seats, beds, rooms, etc. depending
on the specific facility use.
For example:
20,000sf office building
Office facility 8.33units - 1 unit per 2,400sf
Elk River @ $4,079/unit = $33,978 SAC Charge
Rogers @ $4,300 first unit + $1,850/additional unit = $17,860 SAC Charge"
The only changes to the fee schedule since the October 19 meeting are as follows:
The fee for agricultural animals in the R1a and Al districts (chickens) was set at $150. This was
approved by Council at the November 16 meeting.
WAC fee increased by Elk River Municipal Utilities from $2,000 to $2,500 per WAC unit.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION APPROVING NOTICE OF
SUMMARY PUBLICATION OF ORDINANCE #09-_
AN ORDINANCE ADOPTING THE 2010 MASTER FEE SCHEDULE
WHEREAS, on December 21, 2009 the Elk River City Council adopted Ordinance 09-_
approving the 2010 Master Fee Schedule; and
WHEREAS, the enactment of this ordinance establishes fees and charges required by the
City Code and to comply with Minnesota Statutes 462.353, sub.4; and
WHEREAS, the 2010 Master Fee Schedule lists fees and charges for Administrative,
Financial, Environmental, Planning, Development, Building, Parks and
Recreation, Fire, and Police services along with code enforcement violations;
and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any
person at the office of the Elk River City Clerk, 13065 Orono Parkway,
during regular business hours - 8:00 a.m. to 4:30 p.m., Monday through
Friday; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council, by at least four-fifths
vote, authorizes the publication of the title and summary of Ordinance 09-_
and that Ordinance 09-_ shall become effective on January 1, 2010.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER ADOPTING
THE 2010 MASTER FEE SCHEDULE
The City Council of the City of Elk River does hereby ordain as follows:
Section 1.
1. Policy and Purpose: By the enactment of this Ordinance, the City Council
intends to establish fees and charges required by the City Code for the year 2010
and to comply with Minnesota Statutes, 462.353, sub. 4.
2. Fees and Charges: The fees and charges for the city for the year 2010 axe as set
forth on the attached Exhibit A.
3. Application: Where a direct conflict exists between the amount of a fee or charge
set by any provision of the City Code and a fee or charge set by this Ordinance,
the fee or charge set by this Ordinance applies.
Section 2. This ordinance shall become effective January 1, 2010.
Passed and adopted by the City Council of the City of Elk River this 21St day of
December, 2009.

This is not a new item or increased fee but is now being included on the fee schedule.
^ Dangerous & Potentially Dangerous Dogs
The recently adopted dangerous dog ordinance states both dangerous and potentially dangerous
dogs must be licensed on an annual basis. This fee helps offset the costs for warning symbols,
dangerous dog tags, police inspections, and staff follow-up on sterilization and micro-chipping of
the dog.
The initial hearing fee is listed at $100 in the recently adopted dangerous dog ordinance. The
ordinance also states the dog owner will be responsible for actual expenses of the hearing up to a
maximum of $1,000 if the dangerous/potentially dangerous dog declaration is upheld. We would
require the dog owner to pay $500 prior to the hearing which would be set up in an escrow fund.
Any excess funds not used would be returned to the dog owner.
