Background/Discussion
Earlier this year it was noted that that Service Availability Charge was in need of updating. While the
format of the schedule was generally consistent with the Metropolitan Council schedule, there were
inconsistencies in how the units were applied. For example, the Metropolitan Council schedule bases
units on the number of bays; a fixed number. The City schedule based it on the number of employees; a
fluid number.
Additionally, a potential restaurateur expressed dissatisfaction over the apparent high service availability
charge for a sit down restaurant compared to a "to go" or fast food restaurant. Understanding the
Council's desire to attract sit down restaurants, staff is recommending lowering the unit charge for all
restaurants to the standard fast food rate of one per 22 seats.
While sit down restaurants use more water for dish washing, etc, staff believes the amount of loss in
service availability revenues (a one time fee collected at the time of building permit) is not significant and
the goodwill generated will offset the financial reduction.
The remaining changes were primarily clarifications to align more with the Metropolitan Council's
schedule.

AN ORDINANCE AMENDING SECTION 78-189, SERVICE AVAILABILITY
CHARGE OF THE ELK RIVER CITY CODE
WHEREAS, on December 21, 2009 the Elk River City Council adopted Ordinance 09-_
amending Section 78-189, of the Elk River Code of Ordinances; and
WHEREAS, the amendment to the ordinance reduces the number of service availability
units charged for restaurants and includes miscellaneous changes that align
with the Metropolitan Council's schedule regarding the service availability
charge; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any
person at the office of the Elk River City Clerk, 13065 Orono Parkway,
during regular business hours - 8:00 a.m. to 4:30 p.m., Monday through
Friday; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council, by at least four-fifths
vote, authorizes the publication of the title and summary of Ordinance 09-_
and that Ordinance 09-_ shall become effective upon publication of this
resolution.

AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 78-189, SERVICE AVAILABILITY CHARGE, OF THE CITY
CODE OF ORDINANCES
The City Council of the City of Elk River does hereby ordain as follows:

Section 1. Section 78-189, Service Availability Charge, of the City of Elk River
Code of Ordinances shall be amended to read as follows:
(a) Purpose. The debt service for the wastewater treatment facilities shall be recovered from
new connections by a service availability charge (SAC) assessed against new building units.
(b) Applicability; payment; calculation. The service availability charge shall be paid at the time
at which a building permit or a sewer connection permit is issued for all buildings to be
constructed or connected to the sewer system on or after the effective date of the ordinance
from which this article is derived. No charge shall be due upon the issuance of a connection
permit if a charge was paid upon issuance of a building permit. The debt service connection
charge for each building or structure shall be equal to the number of SAC units times the
service availability charge in effect at the time of the application.

(1) Single-family houses, townhouses and duplex units: 1.0 unit.
(2) Condominium and apartment units: 0.8 unit.

moderate income housing: 0.8 unit.
