Background/Discussion In an effort to encourage more residents to participate in the City's SSO program, staff had recommended a change to the recycling rebate structure. At the December 7, 2009 City Council meeting, it was recommended by Councilmember Motin to increase the rebate to $40 to the residents who participate in the City's curbside recycling and SSO program throughout the year and keep the $25 rebate for those residents who only participate in the City's curbside recycling program. Staff has drafted and attached a new rebate application to include those changes. Financial Impact The recycling rebates are funded out of the landfill abatement fund via a transfer at the end of each calendar year to the Garbage fund once we know the amount of participants. The budget impact for the above mentioned change for 2010 will be none as the forms have already been submitted for the 2009 year, credited in January or February 2010. The change will affect the 2011 garbage budget as we estimate a transfer in of $31,625. Estimated participation is 275 households @ $40 and 825 households @ $25. The City of Elk River's recycling rate has dropped to an average of 57% from 59%. Thank you for your continued participation in the City's curbside recycling program! With your help, we can retrieve our high rate, continue to lead the State's recycling rate by example, and minimize the City's dependency on incineration and landfills. To qualify for the $25 recycling rebate, you must complete the entire application including your utility account number and sign it. An additional $15 rebate will be given to all those residents who also participate in the Source Separated Organics (SSO) Program from February 1, 2010 -December 31, 2010. Beginning in 2011, the additional rebate will be available for those who participate in the SSO program for the entire year. If a recycling rebate is due to the applicant, it will be noted as a $25.00 credit (rebate) on the Utility Bill. SUMMARY PUBLICATION OF ORDINANCE 09-10 RELATING TO SOCIAL HOSTING OF ALCOHOL TO MINORS Councilmember Motin stated he would like to review this ordinance at the next worksession. It was added to the December 14, 2009 Worksession. 4. Open Mike No one appeared for Open Mike. 5.1. 2010 Budget and Tax Levy Mayor Klinzing explained that the purpose of this evening's public hearing was to discuss the general city budget and general tax information and that it is not a time to discuss individual property values and taxes. She stated that if individuals have questions or concerns regarding their property values, they should attend the Board of Review meeting in the spring or contact the Sherburne County Assessor's Office. Ms. Johnson briefly outlined the process of this evening's budget presentation and comment period. She stated the Council approved the proposed tax le~~; $11,112,3>1 in September, which is the maximum tax levy the Ciry can adopt 1\t~. Johnson reviewed the tax levy by use and compared the levy with previous years. She also reviewed property tax changes and explained that a number of factors play a role in detri7iuning the property tax amount. Ms. Johnson reviewed general fund revenues and expenditures. Ms. Johnson stated that there were no new positions being added to the General fund budget in 2010. Mr. Simon reviewed the special revenue foods and enterprise funds. He stated that the enterprise funds are self-supportive and not supported by tax dollars. Mr. Simon provided the public with a link to the Minnesota Department of Revenue website for residents to determine if they qualify for a property tax refund. He stated this link is also on the City's website. He concluded that the council will adopt the 2010 tax levy and budget following public input and comments:"' Ms. J ohnsun stated the City's local government aid and market value homestead credit were reduced. by the Governor for both 2009 and 2010. This evening, the council will again review and consider approximately $43,100 in additional General Fund adjustments/collections. hl~. Haug presented the staff report and discussed the proposed changes to both the fee structure, in order t„ encourage more participation in the City's Source Separated Organics (SSO) program, and the annual recycling rebate. She stated staff is recommending no increase in the payment to the garbage haulers. Councilmember Motin had some concerns with reducing the recycling rebate and by doing so risk losing interest in the recycling program. Ms. Haug stated she was open to any suggested rebate amount to encourage participation in both programs. Mayor Klinzing opened the budget and tax levy discussion to the public for comment.. City Council Minutes December 7, 2009 Page 3 Jackie Warfield, 13902 - 227th Avenue NW, stated her property was rezoned from agricultural to residential. She asked the council why her property taxes went up 254%. She stated her property falls under the Green Acres program. Mayor Klinzing stated the rezone, which goes into effect for the 2010 tax year, shouldn't have caused her taxes to increase. She suggested contacting the county assessor to determine the increase in her taxes. Ms. Johnson stated the state Legislature decided to make changes to Green Acres, the property tax deferral program and taxation of agricultural property, and as a result of these changes property owners are seeing an increase in their taxes payable in 2010. There being no one further to speak, Mayor Klinzing closed the public hearing. Mayor Klinzing stated even though there is considerable time spear on preparing the City's budget, it is important time well spent and complimented staff in providing cuts in their budgets. She stated she felt the cuts shouldn't severely impact services for 2010. She also stated that even though the City prepared in 2008 and '~i ~~ i9 Fc~r these cuts, she cautioned using reserve monies in the future to balance the budger. Councilmember Motin agreed with the Mayor's comments and stated he was not Comfortable with reducing the budget any further. MOVED BY COUNCILMEMBER ZERWAS AND SECONDED BY COUNCILMEMBER WESTGAARD TO ADOPT RESOLUTION 09-65 AUTHORIZING THE PROPOSED PROPERTY" 'T.AX LEVY FOR COLLECTION IN 2010 IN THE AMOUNT OF $11,112,391. MOTION CARRIED 5-0. After some discussion, it was decided to move the $43,100 in budget adjustments be moved into the council contingency fund to help offset any further unallottment in 2010. The motion ~ea~ amended to read as follows: MOVED BY COUNCILMEMBER ZERWAS AND SECONDED BY COUNCILMEMBER MOTIN TO AMEND THE MOTION TO ADOPT THE 2010 BUDGETS AS PRESENTED AND ADJUST THE GENERAL FUND BUDGET BY TRANSFERRING $43,100 IDENTIFIED BY STAFF IN THE STAFF REPORT TO COUNCIL CONTINGENCY. MOTION CARRIED 5-0. Councilmember Ivlotin asked if the recycling rebate figures should be determined at this ~,x time. He suggested raising the recycling rebate to $40/year for those residents committed to '~ rerycling at least four items as well as participating in the SSO program. Ms. Johnson stated that staff would review the impact of the proposed recycling rebate changes and bring it back for council approval. 5.2. Non-Resident Fees for Parks & Recreation Programming Mr. Maertz presented the staff report. He stated it would be difficult to determine the total financial impact by adopting non-resident fees to programming, but thought it would be between $2,000 and $12,000. Both he and the Parks and Recreation Commission suggest that a review of the fee structure be done after one year.
