The City Cotmc'l of the City of Ells Riven sloes hereby ordain as follows:
Section 1.
Po1icy and Purpose.- By the enactment of this Ordinance, the City Council
intends to establish fees and charges required by the City Code for the year 2010
and to comply with Minnesota Statutes, 462.353, sub. 4.
2. Eees and Char es: The fees and charges for the city for the year 2010 are as set
forth on the attached Exhibit A.
3. - icication: Where a direct conflict exists between the amount of a fee or charge

set by any provision of the City Code and a fee or charge set b37 this Ordinance,
the fee or charge set by this Ordinance applies.
Section 2. This ordinance shall become effective January 1, 2010.

WHEREAS, on Decemlber 21,
2009 the Elk River City Coun-
cil adopted Ordinance 09 -12
approving the 2010 Master Fee
Schedule; and
WHEREAS, the enactment of
this ordinance establishes fees
and charges required by the
City Code and to comf ly with
Minnesota Statutes 452.353,
sub.4; and
WHEREAS, the 2010 Master
Fee Schedule lists fees and
charges for Administrative,
Financial,, Environmental,
Planning, Devel- apment,
Building, Parks and Recre-
ation, Fire, and Police 'services
along with code enforcement
violations; and
WHEREAS, a copy of the full
�xt of the ordinance is avail -
Ae for inspection by any per -
son at the office of the Elk
River City Clerk, 13065 Orono
Parkway, during regular busi-
ness hours - 8:00 a.m. to 4:30
p.m., Monday through Friday;
and
NOW, THEREFORE, BE IT
RESOLVED, that the City
Council, by at least four - fifths
vote, authorizes the publica-
tion of the title and suix mary of
Ordinance 09-12-and d that
Ordinance 09 -12 shall; become
effective on January 1, 010.
