Memorandum TO: MAYOR AND CITY COUNCIL FROM: STEPHEN ROHLF, BUILDING AND ZONING ADMINISTRATOR .5-/-C DATE: JUNE 18, 2001 SUBJECT: WETLAND CONSERVATION ACT DECISION - MISSISSIPPI RIDGE WCA 01 - 5 Scott Powell is proposing to fill 37,443 square feet or .86 acres of type 3 wetland to accommodate the plat of Mississippi Ridge. Mississippi Ridge is a combination of commercial lots and town homes. The Technical Evaluation Panel (TEP) conceded that filling this wetland was necessary, for safety reasons, to align the access to the plat with a signalized intersection on US Trunk Highway 10. An appropriate wetland replacement area could not be found on the site. The logical area to replace wetland on the site would have necessitated the removal of numerous mature trees in the Wild and Scenic River District for the Mississippi River. Therefore, Mr. Powell is proposing to buy banked wetland credits in Wright County. No banked credits are currently available for sale in Sherburne County. FINDINGS Eagle Soil Services, Inc. prepared a Wetland Delineation Report for the property, dated July 26, 2000. The Technical Evaluation Panel reviewed this issue on April 26, 2001. Combined notification of the proposed filling and replacement plan was mailed out to the appropriate governmental agencies on April 30, 2001. The comment period ended May 30, 2001. No negative comments were received by the city on the proposed wetland plan., from the mailed notice. The Technical Evaluation Panel found the proposed wetland filling and wetland mitigation plan application dated, April 25, 2001, acceptable under the rules of the Wetland Conservation Act with the stipulations listed below. RECOMMENDATION 1. That banked wetland credits are purchased and properly registered with the Board of Soil and Water Resources prior to filling the wetland in question.
