Request by the City of Elk River to Include Government

Request
The Council is asked to consider an ordinance amendment to add as a conditional use in the
Business Park District, government buildings and facilities.

Analysis
As the Council is aware, the City recently changed its definitions for government office and
government buildings and facilities. In doing so, the City created a nonconfoming situation
with the current Sherburne County Government Center. The government center is zoned
Business Park District and under the previous definitions, government offices were a
permitted use in that district. Once courthouses and jails were removed from the
government office definition and moved to the government buildings and facilities
definition, this rendered the County Courthouse and jail facility nonconforming.
In order to correct the nonconformity, staff is proposing that government buildings and
facilities be included in the Business Park District as a conditional use. This would then
allow the County to expand its facility with Planning Commission and City Council approval.

Planning Commission Action
The Planning Commission, at its May 22, 2001 meeting, voted 5-1 to recommend approval
of the attached ordinance including government buildings and facilities as conditional uses in
the BusineSs Park District.
Recommendation
Ultimately, the City Attorney has advised staff that a Public Facilities District is a more
appropriate method of zoning government and institutional uses such as schools. This will
be a lengthy analysis, and the nonconforming situation should be resolved, at least
temporarily at this time. The proposed ordinance amendment accomplishes that task. Staff
recommends that the City Council adopt the attached ordinance amendment.

AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 900.12 OF THE CITY CODE OF ORDINANCES
Case No. OA 01-06
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 900.12.11.C(i.) titled, B-P, Business Park District -
Conditional Uses, of the City of Elk River Code of Ordinances shall be amended add the
following:
f. Government buildings and facilities.
Section 2. That this ordinance shall take effect upon publication as provided by
Passed and adopted by the City Council of the City of Elk River this 21st day of
May, 2001.

Dear Mr. Rohlf:
This is to commend and express our appreciation for continuing the efforts City of Elk
River Building Inspector Terry Tousignant has made in helping maintain our neighborhood.
Our residential neighborhood experienced problems with junk vehicles, car tires and
car parts which became a blight, worsening as time passed.
Ms. Tousignant became aware of the problems, notified the responsible parties of their
obligations to correct the situation, giving them a deadline to do so, followed up, and had the
debris removed. The entire neighborhood was extremely grateful.
Recently, the problems began to reoccur. Ms. Tousignant immediately intervened and
the situation was again abated.
We very much appreciate Ms. Tousignant's successful efforts in helping our
neighborhood and we want the representatives of the City of Elk River to know that.
