MEMORANDUM TO: FROM: DATE: Mayor & City Council Assistant Chief Jeffrey Beahen 06-14-01 SUBJECT: Parking Enforcement Change The local District Judges have requested that we change the fine schedule and format of our City parking ticket. The new judges feel that our current ticket creates a paperwork burden on both the County Attorney's Office and the Court System itself. Their first request was to change our current fines to match those on the District Court Uniform Fine Schedule. Our parking tickets carried a fine of $15.00. The Uniform Fine Schedule carries a fine for parking violations of $20.00. The second request was to create a place on the ticket to display a statute or ordinance number that cites the actual violation. Currently there is not a place to record this information. Recently a segment of parking tickets were dismissed by Judge Varco for lack of probable cause. Adding the statute or ordinance number would have resolved his issues with the tickets. Last, they requested that we make changes in the manner that the tickets are handled when the fine is not paid. The current method is to forward the ticket to the County Attorney for a formal complaint. The requested change is to bypass the formal complaint process and have the officer issue a citation or summons to appear in court if the parking ticket is not paid. If we were not willing to change these items, we would be required fo utilize the State Citation instead of our City parking ticket. Most of the fine revenue would go to the County/Courts with Elk River seeing only a small percentage of the fine. By changing our ticket and ticket protocol we retain the fine revenue in its entirety. We (]re requesting your consent to change the fine amounts on the parking ticket to match the Uniform fine Schedule as requested by the courts. We have redesigned the ticket to reflect the change in fines as well as the procedural issues that (]re laid out on the bottom of the ticket. He will be leaving to accept a position with the Minnesota State Patrol. His last day of employment is July 3, 2001. We are requesting that a conditional offer of employment be made to the next eligible candidate. He is Brandon Ostlie of Prior Lake Minnesota. Brandon is an excellent candidate for this position. The offer would be made contingent on the candidate passing the pre- employment psychological and medical exams as Well as completion of the final stages of the background exam.
