SUBJECT: Abolish Refuse Appeal Board
The Refuse Appeal Board is composed of five members: Kendra Lindahl, Pat
Klaers, Madalyn Moos, Cindy Olson and Councilmember John Dietz. In the
past, Council has appointed a Councilmember to the Refuse Appeal Board on
a yearly basis. In 1992, two citizens were appointed to the Board--Cindy
Olson was appointed to a two year term and Madalyn Moos was appointed to
a one year term. If Council wishes to continue the Refuse Appeal Board, they
must appoint a Councilmember to a one year term and they must appoint
two citizens to the board, as both citizen terms have expired.
However, since there were no Refuse Appeal Board meetings in 1994 or 1995,
staff feels that Council should abolish the Refuse Appeal Board. Appeals will
be handled at a staff level by City Administrator Pat Klaers and myself.
Since the number of appeals has declined as citizens begin to accept the
mandatory pickup ordinance, staff does not foresee having more than one or
two appeals a year. As always, staff decisions would be appealed to the City
Council.
Enclosed is a copy of the City Ordinance Section allowing Council to establish
an appeal board as necessary. Consequently, the Council may dissolve the
appeal board when it no longer serves a function.
Action Requested
Council should abolish the Refuse Appeal Board and direct staff to handle
any refuse appeals at the staff level.

5. As part of the licensing requirement, all haulers serving
multiple dwelling properties must offer recycling service of
metal cans, newspaper, clear glass and plastics. The hauler will
be responsible to provide adequate containers as judged by the
City of Elk River to store each recycled material. The hauler
may contract these services out.
~02.10 BEFUSE COLLECTION SCHEDULE
The contractor shall collect refuse in that portion of the City
described in the contract at least once a week. Exceptions to
weekly collection may be established upon the advice and
recommendation o~ the Recycling and Solid Waste Administrator. No
refuse collection shall take place before 6:00 a.m. or after 7:00
p.m. of any day.
602.12 RATES AND CF~ARGES
1. The owner or occupant of any premises served by a refuse
collection contractor within the City shall pay to the City a
service charge assessed in accordance with rates set forth by
resolution of the Council.
2. ~. The service charge for each premises shall be made
by the City to the owner on a periodic basis. The fee owner of
each Premises will be responsible for all billings.
3. ~. Service charges shall be payable-at the same time
as bills for water service and subject to the same conditions of
payment. If any charge is unpaid on September 1 of any year, the
Council shall levy an assessment against the property equal to
the unpaid charges as of that date plus interest at a rate set by
the Council from that date and a penalty not to exceed ten
percent (10%). The Clerk shall certify the assessment to the
County Auditor for collection in the same manner as assessments
for local improvements.
4. Fund. All service charges shall be deposited in a separate
account in the general fund.
~02.12 - APPEAL BOARD
The City Council of the City of Elk River may establish an appeal
board to consider appeals from the strict application of this
Ordinance. Determinations of appeal board may be appealed to the
City Council.
