Historically, the City has undertaken a street overlay project every couple of years. The
streets for the project are recommended by Phil Hals, Street Superintendent. According
to the City's assessment policy and past practices, the actual bituminous oveday is
assessed at 100 percent of the project cost. The street department tries to keep the cost
somewhat lower by doing all the preparatory work themselves, such as patching, crack
sealing, and sweeping of the streets.
This Feasibility Study estimates the total project cost at $386,400 including 15 percent
overhead. Each residential property is one unit. Industrial lots in McChesney Industrial
Park were given two units. The apartments and commercial properties along Freeport
and Gates Avenues were given assessable units based on their size. There are
estimated to be a total of 250 assessable units. Based on 100 percent assessment, the
estimated assessment rate would be $1,550 per parcel. As a reference point, the 1998
Street Overlay Project was assessed at $1,450.00 per unit.

Typically, the City has held the assessment and public headng the same evening after
bids are received so that actual bid costs can be presented. Using this same type of
schedule, there are four resolutions attached for the City Council's consideration. They
are as follows:
1. A Resolution Receiving the Feasibility Report and Ordering a Public Hearing for
Monday, August 13, 2001
2. A Resolution Determining Assessed Cost and Ordedng Preparation of Proposed
Assessment Roll. The assessment headng would also be held August 13, 2001.
3. A Resolution Ordering the Preparation of Plans and Specifications
4. A Resolution Approving the Plans and Specifications and Ordering the
Advertisement for Bids
It is anticipated that construction bids would be received on August 7, 2001, and be
available for the Council to consider on August 13, 2001, after the public headng and
assessment hearing are held.

A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE

IMPROVEMENT OF 2001
WHEREAS
the Feasibility Report ordered by the Council in Resolution 01-21 has been prepared
with reference to the 2001 Street Overlay improvement and was received by the City
on July 9, 2001; and
WHEREAS the Feasibility Report recommends that the proposed improvement is feasible;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. The City Council will consider the 2001 Street Overlay improvement as
described in the Feasibility Report and the assessment of the property abutting this
proposed improvement for all or a portion of the cost of the improvement pursuant to
Minnesota Statutes, Section 429, at an estimated total cost for the improvement of
$386,400.
2. A public hearing shall be held before the City Council on the proposed improvement on the
13th day of August, 2001, at six o'clock p.m. at the Elk River City Hall Council Chambers.
The City Clerk shall provide two published notices (one week apart) in the official newspaper
with at least three days between the last publication date and the hearing, and mailed notice
ten days prior to the hearing as required by law.

IMPROVEMENT AND ORDERING PREPARATION OF
PROPOSED ASSESSMENT ROLL IN THE MATTER OF
STREET OVERLAY IMPROVEMENT OF 2001
WHEREAS
costs have been determined for the 2001 Street Oveday improvement consisting
of a contract pdce of $336,000, and expenses incurred or to be incurred by the
City in the making of the improvement in the amount of
$50,400, for a total cost of the improvement of $386,400.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
Based upon the City Assessment Policies, it is determined that the portion of this
improvement to be paid by the City and not assessed to benefited properties is
$--0--.
The portion of the cost to be assessed against benefited properties pursuant to the Elk
River City Assessment Policies shall be $386,400.
The assessments shall be payable in equal annual installments and shall extend over a
period of five (5) years, the first of the installments to be payable on or before the first
Monday in January, 2003, with interest at the rate of 5.5% per annum from the date of
the adoption of the assessment resolution.
The City Administrator with the assistance of the Project Engineer shall forthwith
calculate the proper amount to be specially assessed for such improvement against
every assessable lot, piece, or parcel of land, without regard to cash valuation, as
provided by law, and shall have available at the City Administrator's office a copy of the
proposed assessment roll for public inspection.
Upon completion of the proposed assessment roll, the City Administrator shall notify the
Council and schedule a public headng upon the proposed assessment, causing notice of
the hearing by publication and mail to be made at least two weeks prior to the hearing.

A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS
AND ORDERING THE ADVERTISEMENT FOR BIDS
IN THE MATTER OF THE STREET OVERLAY
IMPROVEMENT OF 2001
WHEREAS
pursuant to City Council director, the Project Engineer has prepared plans and
specifications for the 2001 Street Oveday improvement, which plans and
specifications have been reviewed by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
Such plans and specifications, a copy of which is attached hereto and incorporated
herein by this reference, are hereby approved.
The City Administrator shall prepare and obtain the publication of an advertisement for
bids for the making of the improvement pursuant to the attached plans and
specifications. The advertisement shall be published once each week for three
consecutive weeks, shall specify the work to be done, and shall state that the bids will be
received by the City Administrator until 10:00 A.M. on August 7, 2001, at which time the
bids will be publicly opened in the Council chambers of the City Hall by the City
Administrator and the Project Engineer and will then be tabulated for consideration by
the City Council at a meeting thereof at six o'clock p.m. on August 13, 2001, in the City
Council chambers at City Hall. No bids will be considered unless sealed and filed with
the City Administrator and accompanied by a cash deposit, cashier's check, bid bond, or
certified check payable to the City Administrator in the amount of 5% of the amount of
such bid.

2001 Overlay Improvements

INTRODUCTION
This feasibility study was authorized by City Council Resolution 01-21, adopted at their April 9, 2001
meeting. This feasibility study was initiated by the City Council based on the City's ongoing
maintenance program.
This study was conducted to determine the feasibility of overlaying several streets within the City.
The streets considered for improvement are shown on Exhibit 1.
SCOPE
The purpose of this study is to analyze the feasibility of providing a bituminous overlay to several
streets within the City including:

This study will discuss the existing conditions, proposed improvements, and estimated project costs.
The total project cost consists of construction costs plus overhead costs, which include City
administration, engineering, fiscal and legal expenses. Minnesota Statute 429 will be followed to
assess benefiting properties.
EXISTING CONDITIONS
Freeport Avenue and Gates Avenue is a collector road with concrete curb and gutter and ranges in
width from 44 feet to 48 feet wide, with a total length of approximately 3,300 feet. The remaining
streets that are proposed to be overlaid are residential streets with limited amounts of storm sewer.
These streets range in width from 22 feet to 32 feet wide, with a total length of approximately 18,700
feet.
The streets nominally have a two to three-inch thick bituminous surface. Up to this time, there has
been minimal preventive maintenance done on these streets. The streets are generally in good
condition, but additional surfacing is needed to maximize the useful life of these streets before more
costly repairs such as reconstruction are necessary.

PROPOSEDIMPROVEMENTS
The proposed improvement to the streets is to overlay with 1-~ to 2 inches of bituminous surfacing.
The streets can be overlaid while maintaining traffic, so there will be minimal disruption during
construction. Gates Avenue and Freeport Avenue will be milled on either side to ensure that they
properly match into the existing concrete curb and gutter.
In addition, the improvements would consist of milling and/or removal of a small portion of each
driveway to ensure they can be made to match properly with the newly overlaid street.
Exhibit 2 shows the relationship between life of service and strength of pavement. This graph
shows that, once a street reaches 75% of years of service, the pavement strength rapidly drops and
the cost to maintain the road increases. By overlaying these roads, the strength and life of the road
will increase. The overlay will seal the cracking in intermediate stages. The overlay will also fill the
Iow areas in the pavement, which collect water and decrease the life of the pavement. Existing
transverse cracks, which are caused by freeze-thaw cycles, will likely reflect through the overlay in
the future. There may be areas that need to be patched before placement of the bituminous.
EASEMENTS AND PERMITS
The right-of-way width for these streets ranges from 30 feet to 66 feet and is adequate for these
improvements. No work is proposed outside of the right-of-way.
No permits from any local or state agencies will be required for this project.
NECESSITY AND COST-EFFECTIVENESS
The streets being reviewed are in need of repair. The project is necessary to provide the residents
of this area with a safe and adequate public transportation system. If the overlay is not done in a
timely fashion, the roads will continue to deteriorate and reach a point where an overlay will not be a
feasible alternative. The project will minimize maintenance cost, provide a cleaner neighborhood
appearance, increase traffic safety, and minimize disruption outside of the right-of-way and to
adjacent properties. The size of the project will ensure competitive bidding, from this standpoint the
project is cost-effective.
ESTIMATED PROJECT COST
The estimated construction and project cost for the proposed improvements is provided below in
Table 1.
The project cost includes both construction and overhead costs. In accordance with the City's
assessment manual, the overhead costs are estimated as 28% of the total construction cost. The
overhead cost includes city administration, engineering design, construction staking and inspection,
and fiscal and legal costs. Since this project will not require detailed plans and specifications, the
overhead has been reduced to 15%.

FINANCING
As has been the City's practice in past overlay projects, it is proposed that 100% of the cost of the
improvements be financed by assessments to the benefiting properties abutting the improvements.
As outlined in the City's Assessment Manual, all properties with frontage abutting the roads or
properties dependant on the road to be overlaid shall be assessed on a per unit basis. Each
residential property is considered one unit. Lots in McChesney Industrial Park were considered two
units. The apartments and commercial properties along Freeport and Gates Avenues were
assigned assessable units based on their size. The assessable units based on size range from two
units for the Bank of Elk River, eight units for North Memorial Health Care, and fourteen units for
Evans Meadows Apartments.
The total number of assessable units in the residential, industrial, and commercial areas of the
project is 250. Dividing 250 by the total project cost of $386,400.00 results in a per unit cost of
$1,550.0O.
The existing parcels and corresponding property identification numbers forthe benefiting properties
are shown on Exhibit lA through Exhibit 1E.

CONCLUSION
Based on the information gathered and the analyses presented, the proposed overlay improvements
are feasible from an engineering standpoint and would meet all standards set forth by the City. The
improvement in this street would be another step in improving the street infrastructure within the City
of Elk River. The estimated project cost is $386,400.00.
