Request
Nate and Debbie Hildenbrand request approval of an Administrative Subdivision to create
two parcels.
120-Day Rule
To comply with the 120 day rule, without an extension, this item needs to be acted on by
June 19, 2003.

Location
The property is located north and south of 221st Avenue, bounded on the southeast by the
Burlin~n Northern Railroad right-of-way, on the east by ~ Street and lying south of
the 225 Avenue alignment. The Ridges of Rice Lake subdivision adjoins the subject
property to the west.

Analysis
The property totals 108-plus acres which includes an existing house on the portion of the
parcel north of 221~ Avenue east of the proposed Parcel B.
The proposed subdivision would split the property into two parcels. Parcel A will be 105.9
acres and Parcel B will be 2.77 acres. The zoning of this property is A1 with a minimum lot
size of 10-acres. Parcel B is allowed to be less than 10-acres as it will comply with the 4 for
40 rule.
Parcel B will have access from Tipton St, from the Ridges of Rice Lake development,
through what is currently platted as Outlot-G. Outlot-G has been deeded to the applicant
so the property maintains at least 300-feet of street frontage which is required by the
Ordinance. Parcel B is of adequate size to provide space for a dwelling and primary and
secondary septic sites.
Park and Recreation
The Park and Recreation Commission recommended that the City accept cash dedication for
one parcel.
Drainage and Utilities
The City Engineer's memo addresses site drainage and utilities.
Recommendation
Staff recommends that the City Council approve the Hildenbrand Administrative
Subdivision request with the following conditions:
1. ALL COMMENT OF THE CITY ENGINEER SHALL BE ADDRESSED.
2. PARK DEDICATION FEES FOR ONE LOT SHALL BE PAID PRIOR TO
RELEASING THE SUBDIVISION FOR RECORDING.
3. SURFACE WATER MANAGEMENT FEES FOR ONE LOT SHALL BE
PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING.

Dear Mr. Leeseberg:
We have reviewed the supplemental information submitted by Nate and Debbie Hildenbrand for their
proposed administrative subdivision. The supplemental information submitted consists of a site plan
prepared by Taylor Land Surveyors Inc. dated April 24, 2003; a certificate of survey, also prepared by
Taylor Land Surveyors Inc. dated March 15, 2003; an on-site sewage system design prepared by
ECO Systems Inc. dated April 22, 2003; and a copy of a quit claim deed between Ridges of Rice Lake
and Douglas Hipsag, deeding Outlot G of Ridges of Rice Lake to Mr. Hipsag.
The proposed parcel being created out of the original parcel has changed slightly since the original
submittal. It is now more of a rectangular parcel with no future road right-of-way shown. The parcel
being created is approximately 2.77 acres in size. Based on the newly submitted information and
reviewing our previous correspondence dated March 11,2003 (a copy is attached), we would offer the
following comments:
An administrative subdivision should provide a drawing which shows the original parcel
with the proposed parcel cut out of it and include descriptions of the original parcel, the
newly created parcel, and the remnant pa~'cel,, all on' the same. drawing. Taylor Land
Surveyors still has not produced a drawing that has all of this information on one sheet, but
has produced two drawings that, in combination, do provide all the necessary information.
The copy of the quit claim deed, deeding Outlot G from the Ridges of Rice Lake
Homeowners Association to Mr. Hipsag, addresses the issue of the outlots and whether or
not this parcel will have access to Tipton Street. It is clear from this additional information
that the newly created parcel will in fact have access to Tipton Street in Ridges of Rice
Lake.
The site plan shows the location of the proposed house and the driveway connection to
Tipton Street. The topographic information indicates that the driveway will have an 8.2
percent slope. This information addresses our third point in our previous correspondence.
The removal of the future road eliminates the issue previously raised regarding this
potential future road.

Again, with no future road shown, the fifth point in our previous correspondence is also
eliminated.
With the submittal of the ECO Systems design of a septic system on the lot, the location of
a primary and alternate drain field sites are now designated.
Based on the revised information, we are now prepared to recommend approval of the administrative
subdivision for Nate and Debbie Hildenbrand. If you have any questions regarding this information,

Dear Mr. Leeseberg:
As requested, we have reviewed the proposed administrative subdivision for Nate and Debbie
Hildenbrand. The document we reviewed was prepared by Taylor Land Surveyors and was dated
January 21, 2003. This proposed administrative subdivision consists of cutting out a parcel of
approximately 3.56 acres from a larger parcel of over 108 acres. We would recommend that this
request be tabled at this time for lack of sufficient information. The submittal should be revised to
address the following issues:
· The drawing should show the entire 108-plus acre parcel with the proposed smaller parcel cut
out of it. The descriptions on that drawing should include a description of the entire parcel, a
description of the proposed 3.56-acre parcel, and a description of the remnant parcel.
· There are Outlots F and G, which are part of Ridges of Rice Lake subdivision, that lie on the
west side of the proposed parcel. They create a barder between the parcel and Tipton Street.
What will happen with these outlots? Will they be combined with the newly created parcel?
· There should be adequate topography shown on the proposed lot to be created to indicate a
building site and pdmary and secondary septic sites. Also, if any wetlands exist on the
proposed parcel, those should be identified. In addition, adequate topography on the west
should be shown to indicate how the newly created lot will fit with Tipton Street.
· There is a future road shown along the northern boundary of the new site. Is this right-of-way
to be platted at this time? Who will be responsible for building the road? When will it be built?
· Sufficient topography should be provided to indicate that the future road and proposed lot to
be created will fit in with the surrounding already built development on the west side.
I would be happy to sit down with you and the applicants' surveyor to go through these comments in
detail to ensure that the next submittal is more complete. If you have any questions, please call.
