May 5, 2003 File: 818980J-0564 The Honorable Mayor and City Council City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: 2003 STREET REHABILITATION PROGRAM ASSESSMENT HEARING Dear Council Members: As you are aware, the assessment hearing for the 2003 Street Rehabilitation project is scheduled for Monday evening, May 12, 2003. Assessment notices have been mailed to all property owners based on the assessment scenario laid out in the feasibility study. The assessment rate is $5,000 per residential unit, with the school property, City library, churches, and commercial establishments proposed to be assessed more residential units. The interest rate is proposed at 5.50 percent, and the term of the assessment is proposed at 7 years for $5,000 assessments and 10 years for those over $5,000. City Finance Director, Lori Johnson, has indicated that any property owner that feels a 7 -year term is too burdensome would be allowed to extend the term to 10 years to lessen the annual payments. Unlike other assessment hearings, there are a couple of technical issues that need to be presented to the City Council for direction. They are as follows: A. Sidewalks In the feasibility study and at the public hearing, it was indicated that it would be the City's intent to put sidewalks on both sides of all streets if they could be fit in. After having completed the final design and having had a walkthrough with the property owners, it is apparent that it will be very difficult to get any sidewalk on Morton Avenue without impacting mature vegetation. It will be impossible to put a sidewalk on the west side Norfolk Avenue because of the Hanke pit, and replacement of the sidewalk on the east side of Norfolk Avenue can not exceed the existing width of 5 feet without affecting mature vegetation. With these as examples, I am suggesting that sidewalks on the project be installed where they can be easily accommodated without removing mature vegetation, or in the case of Norfolk Avenue, have the standard City width of 6 feet narrowed to the existing sidewalk width of 5 feet so the existing sidewalk can be replaced in its current location. It appears that along the entire length of Fourth Street, it will be possible to get sidewalk on both sides at a width of 6 feet. It seems to City staff that this sidewalk on Fourth Street is more important given the location of Hanke School, public library, the three churches, and the commercial establishments at the east end. Fourth Street Width As you may recall from the feasibility study, we are proposing to narrow the width of Fourth Street from 42 feet to 38 feet. According to Municipal State Aid design standards, a street with parking on both sides and less than 10,000 vehicles per day can be 38 feet. The 1999 traffic count on the west end of Fourth Street was 750 vehicles per day, so even projecting out into the future, it is clear to see that the traffic count will be significantly less than 10,000 vehicles per day. We have received a letter signed by Holy Trinity Episcopal Church and United Methodist Church, which are across the street from each other on the west end of Fourth Street. The letter indicates a desire to have the street remain 42 feet in width for ease of vehicles parking, passengers exiting from parked vehicles, and maintaining traffic flow on the streets. Staff believes that 38 feet is adequate for these types of functions and believes that the 2 feet of narrowing on each side will provide more boulevard space for widening 5-foot sidewalks to 6 feet where necessary and provide an additional foot of boulevard area for snow storage. I am meeting with the representatives of the two churches on Thursday evening, May 8. If I am unable to convince the churches that 38 feet is a good design for Fourth Street, this issue may need to be discussed at the assessment hearing. Attached is the assessment roll for the 2003 Pavement Rehabilitation program. I will be prepared to make a brief presentation relative to the assessments. The two assessments issues I am aware of that may be raised at the hearing are 1) the three residential properties that are corner lots with Main Street that were assessed in the 1989 Main Street project and 2) the number of units that the three churches along the project are proposed to be assessed. Attached is a standard resolution adopting the assessment roll for the 2003 Pavement Rehabilitation program. As we have discussed before, staff is recommending that the City Council not adopt the assessment roll nor award the bid on this project until we are sure of actions the State Legislature may take and how these will affect the City's ability to fund this project. It is anticipated we will not know the answers to these questions on Monday, May 12, 2003. Therefore, staff is recommending that the Assessment Hearing be held, the hearing closed, any appropriate Council discussion take place, but no action on the attached resolution until the City is sure of the effects of any State legislative actions. Green Company RESOLUTION 03 - A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL IN THE MATTER OF THE PAVEMENT REHABILITATION IMPROVEMENT OF 2003 WHEREAS upon due notice properly made as required by law, the Elk River City Council has met and heard and passed upon all objections to the proposed assessment for the 2003 Pavement Rehabilitation improvement and has determined the amount to be assessed against each individual property as the Council deems just; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The final assessment roll, a copy of which is attached hereto and incorporated herein by this reference, is hereby accepted and adopted and shall constitute the special assessment against the lands therein named. Each such tract of land in the assessment roll is hereby found to be benefited by the improvement in an amount not less than the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments, including both principal and interest, amortized in such amount annually as is required to pay the principal with interest at 5.5% over a period of seven or ten years. 3. The owner of any property so assessed may at any time prior to certification to the County Auditor of the assessment or the first installment thereof, pay to the City Treasurer the whole of the assessment on such property, with interest accrued to the date of payment; except that no interest shall be charged if the entire assessment is paid within 30 days after the adoption of this Resolution. Prepayment may also be made after the certification of the assessment or first installment thereof by paying to the City Treasurer/County Auditor the entire amount of the assessment remaining unpaid with interest. In the case of a payment made before November 15, interest will be calculated through December 31 of the year in which payment is made. If payment is made after November 15, interest will be calculated through December 31 of the next succeeding year. 4. The City Administrator shall transmit to the County Auditor a certified duplicate of the attached assessment roll to be extended on the property tax lists of the County.
