Staff is requesting authorization to pursue defining possible changes to the zoning ordinance that may
permit a commercial recreation type facility in a residential zone.

City staff has been approached by Spectrum High School fox this possible amendment.
Spectrum High School received a tennis dome as a gift from a fitness center. State law does not pex~xait a
chartex school with Specti~m's length of service to own property or land. To be consistent with state
law, once the structure is constructed, a thud party must own the s~.•ucture and the land it sits on.
High schools axe institutional uses and are permitted in residential zones as a conditional use. The
conditional use review frequently includes such accessory features as lighted athletic fields, gyms, parking
lots, etc. Because the tennis dome is not owned by Spectrum High School, this use can not be reviewed
as an accessory use to the school.
Spectrum is considering partnering with a third party who would own and operate the tennis dome on
property adjacent to Spectturn High School. For this to occur, carefully constructed amendments to the
zoning ordinance will be necessary, Staff does not support a commercial recreation business in
residential zones, but can see the benefit when such a use perhaps run by a nonprofit} is primarily
accessory to a high school.
It the Council does not see the value in such an amendment, the Council is encouraged to deny the
request.
