Attachments · Location Map · Joint Resolution for Orderly Annexation · Big Lake Township meeting minutes of June 27, 2001 · Certificate of Survey Analysis In 1995, the City Council annexed a small portion of property owned by Mr. Engstrom surrounding his home located in Big Lake Township. The Council in June approved an administrative subdivision of 22 acres into two parcels. Of the 22 acres, 1.94 are located in Big Lake Township. In order to combine the properties for tax purposes, the County has suggested that the 1.94 acres be annexed to the City of Elk River. Staff has no opposition to the annexation request by Mr. Engstrom. It will create an odd jog in the City's corporate boundaries, however, it does not adversely affect any adjacent parcels, as Mr. Engstrom is the owner of additional land west of the subject property located in Big Lake Township. Recommendation Staff recommends that the City Council approve the attached Joint Resolution for Orderly Annexation and it will be signed by the Mayor and Big Lake Township Board members and sent to the State for review. That the following described area in Big Lake Township is subject to orderly annexation pursuant to Minnesota Statutes 414.0325, and the parties hereto designate this area for orderly annexation, to wit: That part of the Northeast Quarter of the Southeast Quarter of Section 13, Township 33, Range 27, Sherburne County, Minnesota described as follows: Commencing at the northeast corner of said Northeast Quarter of the Southeast Quarter, thence on an assumed bearing of South 2 degrees 3 minutes 54 seconds east along the east line of said Northeast Quarter of the Southeast Quarter, a distance of 426.81 feet to the point of beginning; thence continue south 2 degrees 3 minutes 54 seconds east along said east line a distance of 410.82 feet; thence north 85 degrees 27 minutes 37 seconds west a distance of 256.95 feet; thence north 2 degrees 3 minutes 54 seconds west a distance of 20.27 feet; thence north 12 degrees 40 minutes 47 seconds east a distance of 379.65 feet to a line that bears north 89 degrees 50 minutes 55 seconds west from the point of beginning; thence south 89 degrees 50 minutes 55 seconds east a distance of 158.77 feet to the point of beginning. 2. That the Town Board of the Township of Big Lake, and the City Council of the City of Elk River, upon passage and adoption of this resolution and upon acceptance by the Municipal Board, confer jurisdiction upon the Municipal Board over the various provisions contained in this Agreement. 3. that the square foot property to be annexed abuts the City of Elk River and 4. That annexation of the property identified in Paragraph No. 1 above is therefore in the best interest of the area proposed for annexation and the aforementioned property will be immediately annexed to the City of Elk River. 5. That upon annexation, the property annexed shall be zoned 6. Both the Town of Big Lake and the City of Elk River agree that no alteration of the stated boundaries of this agreement is appropriate. Furthermore, each party agrees that no consideration bythe Municipal Board is necessary. Upon receipt ofthis resolution, passed and adopted by each party, the Municipal Board may review and comment, but shall, within thirty (30) days, order the annexation in accordance with the terms of this joint resolution. The purpose of the meeting was to discuss traffic safety issues. Traffic lanes, entrances, and turn lanes were discussed. Loading zones end drop-off areas for student transportation were also reviewed, Treasurer Wameke advised that the dght of way along 205u' Avenue, according to Township plat documents, in the area of Bumtwood is 33'. The construction schedule was discussed. It was noted that the anticipated date for base work was fall 2002 with final construction in the spring ol 2003, and the openin0 of the school in the fall of 2003, A second joint meeting for the ;~ig Lake School Board, City of Big Lake, and Town of Big Lake will be scheduled in September to discuss progression and plans. There will also be a need to resolve issues regarding the funding of sidewalks and any other pedestrians traveling areas, MNDoT advised that the Township may be able to apply for some kind of grant money available in 2004 for this. MNDoT also advised that a speed study could be conducted in April or May of 2003. The Township will need to request this by letter. b. Other - -Terry Herman, Township Engineer, presented the change orders for Bauredy Brotl~ers for the addition of the paving of the extension of service drive between Twin Pines and Farm Services Addition, and for the repair of 196~ Avenue, totaling $16,220.50. Supervisor AJfords motioned to approve the change order for Bauerly Brothers, Supervisor Hofer seconded. All present were in favor. The motion carded. -Treasurer Warneke advised that the outside audit conducted by Kaliher and Passolt has been completed. The will be reviewed and presented at the next meeting. Chairman's Report- ,~' 1. Arne Engstrom/Request for Annexation of 1.94 Acres into the City of Elk River - Ama Engstrom presente~ a request to annex 1/g4 acres to the City of Elk River. This would combine two separate properties into one, creating one title description and one property identification number for a single 10 acre parcel. At this time he is in the process of selling the house, and farm buildings to his daughter. The additional 1.94 acres contains the garage, a shed, most of the septic system artd a swimming pool would be combined with the home site. Chairman Petersen advised that it is possible for the City of Elk River to deny his request for annexation. After discussion Supervisor Hofer motioned to allow Ama and Madlyn Engstrom to continue their efforts to annex the 1.94 acre building site into the City of Elk River subject to Elk River's acceptance Supervisor Alfords seconded All present were in favor. The motion carded. 2. County Buildability Requirements for New Plats/Mottled Soil Indicator- Chairman Petersen advised that he had attended the County public hearing regarding thls, He also received a call from Nancy Riddle, Sherburne County Zoning Administrator, requesting that 11; the Township has a position on this, that it be submitted in a letter to the County. There was discussion regarding the use of the term mottled soil and its interchangeable use with other soil measurements such as water table, and 100-year Ifigh water mark.
