Request:
The applicants request that the City Council approve an administrative subdivision to create two
parcels.

Location
The property is located at the Southeast corner of the intersection of County Road 1 (Elk Lake
Road) and County Road 33 (Ranch Road).
Zoning and Land Use
Rla (2 ~h acre district)/LR, Low Density Residential.
Analysis
The subject property is located in the Southeast quarter of the intersection of County Road 1
and County Road 33 and totals 14.52 acres. The site is predominately low and vegetated with

trees. A 240-foot wide Northern States power line easement crosses the property in a Southeast
to Northwest direction.
The applicants are proposing to split the property into parcel A of 9.63 acres and parcel B of
4.89 acres. The new parcel indicates a house pad as well as adequate space for a primary and
secondary septic facility. The applicant has had the site reviewed by a certified septic inspector
and he has identified that at least one location on site that would allow for a traditional septic
system with other sites requiring a mound system.
Park Dedication
The Park and Recreation Commission reviewed the subdivision request for park dedication
purposes at their July 11, 2001 meeting. They recommended that dedication be obtained via
cash for one lot.
Access
The new parcel will access County Road 33 with a separate driveway from the existing home and
garage. The County will require an additional right-of-way for County Road 33 and the
applicant will be required to imply with the County requirements for access permits and right of
way.
Recommendation
Staff recommends that the City Council approve administrative subdivision request AS 01-07 by
Mike and Vicki Gwynn to create one lot with the following conditions:
1. All comments of Sherburne County be addressed.
2. Park Dedication fees shall be paid for one lot.
3. Storm water fees shall be paid for one lot.

along County Highway 33. After reviewing the d.ntwings that we received in our office they mex:t
our requirements and we support his request. Sherbume County requires 50' of right of way be
granted in fee title and an access permit be applied for Parcel B, before any construction begins.
