REQUEST FOR CONDITIONAL
USE PERMIT AND SOLID WASTE
FACILITY LICENSE
AMENDMENT
Prepared for:

Executive Summary
The Elk River Landfill, Inc. (ERL) proposes to develop an additional approximately 13 acres of
Municipal Solid Waste (MSW) landfill space on the southern-most portion of the existing 137.4-
acres landfill property -that is, the property which is south of the existing approved disposal
area to the edge of the existing 137.4-acre landfill property. The existing solid waste landfill
will reach its currently permitted capacity in approximately three years, and the proposed
expansion will provide approximately 1,671,000 cubic yards of additional MSW capacity. At
current waste flows, this additional capacity would extend the operational life of the landfil l
e _
approximately 4 to„ 7 year and provide additional landfill capacity for the City of Elk River
(City), Sherburne County, and surrounding area.
The proposed expansion is on land currently within the Solid Waste Facility overlay coning
district. This Application requests the City to amend the existing Conditional Use Permit and
Solid Waste Facility License to provide for the proposed expansion of the landf I1 to the southern
edge of the facility's current property.
The proposed. expansion is consistent with the goals and policies contained in the City's 2004
Comprehensive Plan. The proposed expansion would. not require additional City infrastructure
or services. The proposed expansion would benefit the community by providing access to stable
and reliable solid waste service, as well as a sustainable alternative energy source.
The proposed end~us_e for the site would continue to be open space, which would be compatible
with any adjacent future development to the west, east and south.

1.0 Introduction and Background
The ERL proposes to develop an additional approximately 13 acres of MSW landfill space on
the southern-most portion of the existing landfill property. The proposed expansion would
provide approximately 1.67 million cubic yards of additional MSW disposal capacity at the 1RL.
The proposed expansion would be integrated into the contours, general design and operation of
the existing permitted landfill.
1.1 BACKGROUND
The ERL owns and operates a 476.8-acre landfill site, located approximately 5 miles north of the
business district in the City, in the NW '/4 of Section 3, Township 33N, Range 26W and in the
SW '/4 of Section 34, Township 34N, Range 26W (Property) in the City. The Property controlled
by the ERL can be seen in the attached site plan.
Of the total 476.8 acres, approximately 164 acres is currently permitted for waste disposal; the
remainder of the property (312.8 acres) serves as buffer property. The landfill is permitted wzder-
MPCA Permit SW-74 to receive MSW, demolition and construction debris, yard waste for
composting, industrial solid waste in accordance with an MPCA-approved Industrial Solid:
Waste Plan, and. processing facility rejects from the Elk River RDF combustor facility.
1.2 THE CITY'S APPLICATION REQUIl2EMENTS
The ERL maintains a solid waste facility license agreement and conditional use permit in
accordance with the City's requirements. Both of these documents require amendments for the
landfill proposed expansion, and the required information is included within this document.
T:\g742\I40l,\CiNAppFe61FEB Report_Final (2).doc 1 - 1
2.0 Description of Proposed Project
2.1 PROJECT DESCRIPTION
The ERL proposes to develop an additional approximately 13 acres of MSW landfill
space on the southern-most portion of the existing landfill property. The proposed
expansion will provide approximately 1,671,000 cubic yards of additional MSW
capacity. Depending on waste flow quantities, the proposed expansion would extend the
operational life of the landfill approximately 4 to 7 years by providing additional landfill
capacity.
2.2 CURRENT FACILITIES AND OPERATIONS
Landfill operations are performed under the direction and oversight of licensed landfill
operators. In addition to t~~pical utilities such as water, sewer, electricity, and phone
service, infrastructure requirements special to the landfill are: leachate and gas
condensate storage facilities and their associated leachate and gas piping components.
As far as landfill facility structures, the ERL currently has the following on-site
buildings:
• Scalehouse: Located on the east side of the facility with scales on both sides.
Landfill Office and Maintenance Building: Precast concrete building located
northeast of the existing MSW area. The building houses the landfill offices,
maintenance area, including the oil storage facility.
• Gas-to Energy Plant: Precast concrete building on the northeast end of the
current MSW facility just east of the landfill office. The gas to energy plant
T:\o742\I40fi\CiryAppFeb\FEB Report final (2).doc '1- 1
houses a community education room and the generators for the gas to energy
facility.
• Recycling Building: Metal sided building that serves as storage for recyclables
and as part of the citizen drop-off and convenience center service to the public.
This building is located to the south of the office building.
2.3 NEED FOR EXPANSION
The existing MSW landfill will reach its currently permitted. capacity in approximately
three years. The ERL has available land. to the south of the existing landfill footprint
within the solid waste overlay district that can be used for the proposed expansion of the
MSW landfill. By increasing the footprint of the landfill, the ERL is able to efficiently
increase its capacity and extend its life. Since the existing landfill already has the
infrastructure, environmental monitoring systems, and operations in-place, it provides an
environmentally safe area for the proposed expansion of a needed facility while
providing a benefit to the community that extends beyond waste disposal needs.
The need for additional landfill space for the expanding greater metropolitan area has
been documented by a division of the MPCA (formerly Office of Environmental
Assistance), whose purpose is to identify waste management practices and places
importance on waste reduction, reuse and. recycling. Despite the successes in Minnesota
at reduction, reuse and recycling, the quantity of waste generated has substantially
increased over the past decade and with it, a corresponding need for additional MSW
landfill space.
T:10742\I40C\CityAppFeb\FEB Repon_final (2).doc ~-~
2.4 PROPOSED FACILITIES AND OPERATIONS
2.4.1 Infrastructure
Expansion of the following existing infrastructure systems will be required as part of the
proposed project:
• Gas extraction wells, piping, and monitoring probes installed in accordance with
the New Source Performance Standards (NSPS) and Title V air permit.
• Gas to energy plant and. back-up flare in accordance with the Title V air permit
and NSPS regulation
• Leachate collection and management as approved by the MPCA
• Groundwater monitoring wells as approved by the MPCA.
2.4.2 Operational Impacts
2.4.2.1 Hours of Operation
The ERL will continue to limit its operations to the hours of 6:00 am to 7:00 pm, Monday
through Saturday, excluding holidays. During that time, the landfill will be operated in
accordance with the operational requirements enforced by the MPCA, Sherburne County
and the City. The landf I1 may accept waste during the off hours only under certain
circumstances.
2.4.2.2 Traffic, Parking, and Signage
The ERL employs approximately 14 people at the current landfill site. There are 20
parking stalls located at the office building site as well as ample room for parking in the
yard area to the north of the building. The landfill employee numbers are not expected to
increase with the proposed expansion. Additionally, there is no increase in traffic to the
facility expected with the proposed expansion.
T:\0742\I4D(,\CityAppFeblFEB Repon_Bnal (2).doc 2-~
The ERL will maintain existing signs at each entrance to the site which describes the
wastes which may be disposed at the ERL and those wastes which will not be accepted.
In addition to waste acceptance information, the site signage also indicates the schedule
of days and hours the facility is open to the public, prices for waste disposal at the site,
the MPCA permit number, contact person for landfill issues, and the penalty for
nonconforming dumping. No new signs are proposed for the proposed expansion.
2.4.2.3 Equipment Storage
Adequate on-site enclosed storage is available for the maintenance and storage of the
landfill equipment that is currently needed to operate the landfill. It is not anticipated
that additional equipment and/or equipment storage facilities will be required with the
proposed expansion.
2.5 ENVIRONMENTAL AND COMMUNITY IMPACTS AND MITIGATION
The proposed expansion does not require an Environmental Impact Statement (EIS)
under the requirements of Minn. 8.4410.4400, subp. 13(E) since the increase in volume
is less than 25 percent of a previous capacity of a MSW disposal facility for 100,000
cubic yards or more of waste fill per year. Moreover, the MPCA did conduct an EIS for
a much larger proposed expansion of the landfill, which included the proposed expansion
The following discussion provides a summary of the expected impacts associated with
the proposed expansion. Many of these findings are also discussed in section 3 of this
report.
2.5.1 EnvironmentalImpacts
2.5.1.1 Groundwater
T90742V 40(,\CilyAppFeblFBB Repon_finni (2).doc 2-4
The hydrogeologic conditions within the additional footprint area are suitable for the
proposed expansion. The monitoring program which is currently part of the ERL
operations includes testing to provide early warning of a release, should one occur. "1'he
groundwater monitoring well network includes numerous downgradient wells that are
properly positioned to observe existing and future groundwater conditions at the site.
The groundwater monitoring network along the southern boundary will be modified in
accordance with any recommendations from the MPCA during the application submittal
and approval process.
2.5.1.2 Surface Water
The ERL is currently operating under a Stormwater Pollution Prevention Program
(SWPPP) that exceeds MPCA requirements. The existing SWPPP will be amended to
cover the additional footprint should it be approved.
2.5.1.3 Air Quality
Methane gas generated from the waste disposed of within the proposed expansion will be
used to generate electricity at the existing gas to energy plant. As does the existing
landfill, the proposed expansion has the potential to generate odors. Emissions are
monitored on site and odor complaints are investigated and causes mitigated promptly.
2.5.2 Community Impacts
2.x.2.1 Visual Impacts
The proposed expansion will be effectively screened from Highway 169 along the eastern
side by existing berms and trees. Similar to the 200-foot buffer between the trail and the
existing facility, there will be a 200-foot buffer from the property line to the cell
boundary along the western side of the facility that consists of an existing densely
wooded area between the proposed landfill and trail corridor. This 200-foot buffer
T:\0742\140C\CityAppFeb\FEB Report_final (2).doc 2-`
effectively screens both the existing facility and the proposed expansion from the
corridor trail.
Mining activities to the south of the proposed expansion will be ongoing during the life
of the project. In addition to the existing screening along 221St Avenue for mining
operations, the ERL will establish screening vegetation on the southern berm that will
effectively screen the proposed expansion.
2.5.2.2 Land Use Compatibility
The proposed expansion is located within the existing property, which is within the Solid
Waste Facility overlay zoning district, and guided "Landfill" in the City's 2004
Comprehensive Plan. The City's 2004 Comprehensive Plan also states that the "Landfill
use is consistent with the current land use plan".
The proposed expansion is also consistent with the Sherburne County Solid Waste
Management Plan.
The proposed expansion is also consistent with the existing Hwy 169 and the future Hwy
169 corridor plans, and will not affect any future interchange designs at the intersection
of Highway 169 and 221st Avenue.
2.5.2.3 Economic and Social Impacts
The economic and social impacts of the proposed expansion are similar to those of the
existing ERL facility. Revenues currently collected by the City, Sherburne County, and
the State of Minnesota from tipping taxes and fees would be sustained for the additional
volume associated with the proposed expansion over the additional life of the landfill
(1.67 million cubic yards over 4 to 7 years). Similarly, the other economic benefits
associated with the ERL facility to the surrounding community in the way of commerce
T90742U 40E\CityAppFeb\FEB Report_flna~ (2).doc 2-6
with local businesses, donations, employment, etc. would be sustained for an additional 4
to 7 years.
2.6 SITE SCREENING
The region surrounding the proposed expansion consists of rolling terrain, heavily
wooded areas, existing berms, and on-going mining operations that effectively screen it
from view without additional screening features.
Along the east side of the proposed expansion, existing trees and an existing earthen
berm that has been planted. with trees, will provide year round screening along I-lwy 169.
Mining activities to the south of the proposed expansion will be on-going during the life
of the proposed expansion. In addition to the on-going mining on the property to the
south of the proposed expansion and existing screening along 221St Avenue for the
mining operations, the ERL will establish screening vegetation on the south perimeter
berm that will effectively screen the proposed expansion from 221St Avenue. Along the
west side ofthe proposed expansion between the property line and the corridor trail there
will be a 200-foot buffer. This setback allows for the preservation of the existing trees in
the area. The dense vegetation along the bike trail corridor effectively screens the
proposed expansion from view of the trail users. This vegetation will remain with the
expansion since it is within the proposed 200-foot setback.
2.7 PROPOSED LANDFILL DESIGN
The ERL is designed to dispose ofnon-hazardous solid wastes. The design as well as the
construction and operation of the landfill are governed by the MPCA who has performed
a detailed review ofthe design of the existing facility, and will perform a detailed review
of the design of the proposed expansion upon submittal of the necessary MPCA permit
application.
T:10742\I40(1CiryAppFeb\FEB Repon_final (2).doc 2--7
The proposed design is consistent with the existing design in that it incorporates a state, of
the art composite liner system; 2 feet of compacted clay soil barrier overlain by a 60 mil
high density polyethylene flexible membrane liner. Together, these two components of
the liner system prevent contaminants from penetrating the surrounding environment.
Overlying the liner section is the leachate collection layer. The leachate collection layer
consists of either 1 foot of highly permeable drainage sand or a synthetic drainage
material called a geocomposite. The geocomposite is comprised of high density
polyethylene channels manufactured to rapidly convey liquids and is considered equal to
the transmission capacity of 1 foot of drainage layer sand.

Cover System
The landfill base liner, in conjunction with the final cover liner, completely encapsulates
the MSW materials from the surrounding environment.
The site currently generates electricity from the methane gas extracted during the waste
degeneration process. The methane extraction system will continue to be developed as
the landfill is final covered. The landfill gas extraction wells are constructed in
accordance with industry standards and the ERL's air permits.
The proposed expansion will be constructed as an additional phase (Cell 18) consistent
with the current series of phased cell construction and closure projects. The timing of the
projects will be dictated by incoming waste volumes and site operations. It is anticipated
that the Cell 18 of the landfill will be partially constructed in 201 1.

2.8 LANDFILL CLOSURE
The ERL has site-specific provisions in place for the closure of the landfill in accordance
with their site permits. The ERL guarantees these closure activities, as well as post-
closure care and. potential contingency actions that may be required, through the use of a
surety bond in accordance with the financial assurance requirements by the MPCA.
Closure-plans for the existing portions of the facility have previously been approved by
the MPCA, Sherburne County and the City, and upon submittal of the necessary MPCA
permit application for the proposed increase in footprint, updated closure, post-closure
and contingency action plans and cost estimates will be submitted. Final contours,
surface water drainage calculations, and an end use plan are included in this submittal.
As the ERL enters closure of the landfill, existing fencing will be utilized and
supplemented as necessary for the purposes of security. After final closure of the site,
while the entire site will be secure, certain portions of the site will be secured such that
only those persons authorized by the ERL will be permitted in these areas to perform
closure and post closure activities.
2.9 CLOSURE CONSTRUCTION.
The proposed expansion will be closed as part of a phased closure construction. The
anticipated closure sequence and timing for the proposed expansion will occur i~1
approximately 2018, as part of the final phase of closure construction. The timing of
construction will be dictated in part by incoming waste volumes. Closure of the landfi l l
includes the engineered cover system, gas collection components, and the surface water
controls included MPCA permit application documents and approved by the MPCA.
The City, as well as the MPCA and Sherburne County, will be notified of impending
phased closure at the ERL prior to initiation of closure construction. The details of the
T:\0742\] 40[\CimApppeb\FEB Repon_6na1 (2). doc 1- 7 O
final closure project will be detailed in the notification for final closure and will include a
notification process for regular customers and in area newspapers. Additionally, the FRI,
will post a sign at the site's entrance 60 days prior to closing for waste acceptance that
notifies landfill customers of the closure date and alternative disposal locations. I_,andfill
final closure activities will proceed within thirty days of receipt of the last load of waste.
The ERL will update the City as to any revisions to the closure sequence as incoming
waste volumes may change over the life of the proposed expansion.

TILLER CORPORATION APPLICATION FOR AMENDMENT TO
CONDITIONAL USE PERMIT
FOR MINERAL EXTRACTION
INTRODUCTION
Tiller Corporation (Tiller) is seeking an amendment to an existing Conditional Use
Permit (CUP) for Mineral Extraction on parcels of land located in the northern
portion of Elk River. The permit was issued in May; 1996. The proposed
amendments are limited to Condition #20 of the current CUP.
The proposed amendment involves mining the southern boundary of the Elk
River Landfill, Inc.'s (ERL) property. Condition #20 of the CUP requires no
mining operations be conducted, and trees be left in place, within 200 feet of
property lines. The amendment seeks to allow removal of trees and mining
within the area that is 200 feet from the south property line.
Figure 1 is a general location map of the site. Figure 2 illustrates the existing
mining setbacks and proposed revisions to mining setbacks. Figure 3 is a USGS
Quad Excerpt.
Site operations will be consistent with the current CUP. Operations will consist of
stripping the area to be mined, removing the aggregate with a front end loader,
screening and crushing the material and hauling it north or south to Tiller's
existing processing area. There is a haul road established between ERL's
property and Tiller's property.

4) Names and addresses of property owners within 350 feet:
See attached Exhibit B.
5) Purpose of Proposed Extraction:
The purpose of the proposed extraction is to remove an existing deposit of
sand and gravel and process it into construction aggregate. This is a high
quality aggregate deposit which will be-used to`supply construction
materials to Elk River and surrounding areas.
6) Estimated Time Required to Complete the Proposed Extraction:
Mining activity under the current CUP is nearing completion. Mining of the
southern most portion of the site will take an estimated two years to
complete.
7) Transportation Routes:
The amendment will have no impact to traffic routes. Material will be
hauled or conveyed..directlyfrnm ERL's property to Tiller's existing
operations without accessing ary public roadways. Trucks hauling the
material will enter public roadways from existing access points.
8) Physical relationship of site with respect to the community:
The site is located near the northern boundary of Elk River. It is
immediately west of U.S. Highway 169 and approximately 3 miles north of
the developed area of Elk River.
9) Site analysis:
The property consists of ERL's operations. In the past, mining has been
conducted over the entire site (excluding setback areas) in phases. Each
phase of mining was followed by the construction of a phase of the landfill.
Currently, other than the 200 foot area, only a small portion of the site
remains to be excavated in preparation for landfill construction. A haul
road has been constructed within the zone to allow access of equipment
and transfer of material between ERL's property and Tiller's operations to
the north and south.
10)Estimate of Quantity of Material to be Mined:
The estimated quantity of material to be removed from the amended
mining area is approximately 750,000 cy.
11)Depth of Water Table:
The depth of the water table was identified in the EIS prepared for the
gravel overlay district within the City of Elk River. The elevation of the
water table in this area is approximately 955 - 957 feet above mean sea
level. No mining will occur within the water table.
12)Average thickness of overburden:
The average thickness of overburden is estimated to range between 0 and
5 feet. The overburden is a sandy loam.
13)Plan of Operation:
The plan of operation is to strip the additional mining area. Topsoil and
overburden will be used for final cover and/or as cover material at the
landfill.
The underlying sand and gravel will be removed using front end loaders.
It will be crushed and/or screened at the working face and then conveyed
or hauled, on the existing haul road, and stockpiled at Tiller's existing
facilities.
14)Explosives:
No explosives will be used at the site.
15)Drainage, Erosion Control, Sedimentation, Dust, Access Control and
Security:
i) Surface water drainage will be directed to a low area within the
excavation. Collected surface water infiltrates into the underlying soils
and/or evaporates. Surface water drainage will not be directed off site.
Sedimentation may occur in temporary holding areas. These low
areas can readily be cleaned out by on-site equipment.
ii) Since water drainage will be directed internally, erosion will not pose a
problem.
iii) Dust will be controlled by watering internal haul roads as necessary.
Additionally, conveyors may be used within the site minimizing truck
traffic on internal haul roads.
iv) Access is controlled by locking gates at site entrances to both ERL's
operation and Tiller's mining operation. Both sites are fenced.
16)Reclamation Plan
Reclamation activities at the site will consist of construction of landfill cells
as shown in Elk River Landfill, Inc.'s application dated February 2010

General Planning Permit Request Narrative
Elk River Parks and Recreation Farmers Market
Detailed Description/Scope of Proiect
The Elk River Parks and Recreation Department is requesting to host the Farmers Market
at the parking lot of the City of Elk River's Westbound Liquor Store located at 13484
185th Street. Two sections of the parking lot would be utilized as indicated on the
attached map.
The Market consists of 12 vendors selling a variety of products including standard
vegetables such as sweet corn and carrots as well as more unique vegetables such as bok
choy and egg plant. Fruits, smoothies, and flowers are examples of other products sold.
Compatibility with Surrounding Properties
The main impact on the area would be the potential for increased traffic from Farmers
Market shoppers. The parking lot has access off of 185' Ave which has a traffic light
controlled intersection with Highway 10.
Operation Information
• Hours of operation: 3:00 - 7:00 p.m.
• Days Open: Thursdays
• Total time on property: From issuing of permit through September 30, 2010
Number of Employees
• One Parks and Recreation staff directly supervises the Farmers Market.
• The vendors have approximately 24 people on site.
Number of Parking Stalls Being Utilized/Remoyed
Eight parking stalls and 100 feet of curve as indicated on attached map.
Temporary Signage
A banner advertising the Farmers Market would be placed as indicated on the attached
map by the parking lot curve facing Highway 10. Only one sign would be utilized and
would remain up through the conclusion of the Market on September 30, 2010.
Outdoor Storage
There would be no outdoor storage.

March 31, 2010
To whom it may concern,
We at Learning Blocks Childcare, LLC are currently at full enrollment at our existing location and are
looking to expand our program to meet the needs of our clients and community. Our plan is to move our
school age children into the new space allowing our center to expand by approximately 36 children. By
making this move we will be capable of meeting the needs of our current families with school age
children or the children that will become school age as of the fall of 2010. Without this addition we will
not have the capacity to meet the needs of our soon to be school age families in addition to the families
that are currently enrolled in our school age program.
We are licensed for 116 children. Of these children 30 of the spaces are for school age. Our school age
program is full with no openings in the near future. We have 19 families that will have children entering
Kindergarten in the fall of 2010. By moving our school age program to the new location within the same
strip mall, will allow us to continue to provide childcare for all of our families. We would open the
current school age classroom for Kindergarten and older preschool children.
At our current position we will not have a preschool opening for a minimum of three years. With this
move we will be capable of adding an additional preschool space for childcare and an AM and PM
preschool program. On a weekly basis we are turning away three to four families looking for preschool
care or class time. We would open our school age program in the new location for AM and PM preschool
time on days that the school age children have school.
The scope of the project will entail:
• conditional use permit for zoning the new location for childcare
• Addition of two toilets with one new bathroom added
• Addition and moving of a total of three sinks
• General cleaning and painting of walls
• No Exterior Construction is necessary
Our hours of operation will be 6 AM to 6:30 PM Monday thru Friday
We will be employing approximately three staff members at the new location in addition to the 21 people
currently employed at our current location.
__
The parking lot is shared for all tenets and is more than aa~q~ate (see site plan)
DATE DECEIVED
~(3~ tO
Signage will be in the future but not as of current. In the future we would like to have a sign on the
building in channel letters to fit the space of approximately twelve feet by two feet on the front of the
building.
As per our conversations with Chris at the Elk River planning department we have omitted a proposed
screening site or outdoor storage because it is not applicable to our request.
For further information please contact Gary Erickson at 763-772-2918 or Tina. Erickson at 763-772-2915.
