SUBJECT: Consider Change Order for Elk Hills
Drive/Dodge Avenue Improvement
Project
The city engineer will distribute a report on this agenda item at Monday
night's meeting. The city engineer, city planner, city attorney and I have all
had conversations with Gary Santwire (representing REP) regarding this
change order. In turn, Gary Santwire has had numerous conversations with
the owner of McDonalds in order to get his concurrence with the change
order.
We are all in agreement that the change order makes sense to minimize
construction in this area when a 1996 Dodge Avenue project takes place. It
is anticipated that by Monday evening, staff will have received a signed
waiver of assessment appeal statement from the benefited property owners
which will state the amount, interest rate, and length of the assessments for
the four benefited property owners. One hundred percent of the cost of this
change order is planned to be assessed out to these individuals per our
mutual agreement.
Unless something changes between now (Thursday) and Monday's Council
meeting, staff recommends approval of the change order and the assessment
appeal waiver as presented by the city engineer and city attorney.

RE: ELK HILLS DRIVE AND DODGE IMPROVEMENT PROJECT
CHANGE ORDER NO. 1
Dear Council Members:
Mr. Gary Santwire representing REP Limited, David Decker, and McDonalds has
approached staff concerning a change order to the Elk Hills Drive/Dodge Improvement
project. The change order would add to the construction of Dodge Avenue south from its
current terminus point to the south lot line of the McDonalds property. Mr. Santwire
uw~ ENGINEERING indicated the property owners that he represents are interested in having this added to the
ENVIRONMENTAL current project so in the future there would be no disruption in front of their properties.
MUNICIPAL Mr. Santwire indicated that the property owners he represents are willing to sign a petition
PiANNING and waive their rights to appeal an assessment for the Dodge Avenue improvement.

sTRUCruRAL City Attorney Peter Beck has drafted the necessary petitions and waivers for the four
suRVErING property owners involved. They include the three office buildings north of McDonalds and
