First of all, I would like to apologize for my family and neighbors for not sending this email or a
formal request sooner. I was planning on putting an article first in the local paper emphasizing
the importance of the request, but the time has come to submit a formal request for an all-way
stop sign at the intersection of 193rd Avenue and Xavier St NUV. I was informed that the subject
of this intersection may come up in tomorrow's meeting X415}. I did not see it on the posted
agenda. Unfortunately, I am not able to make tomorrow night's meeting and an open Mike
discussion because of other commitments.
I could go on and on about the 193rd Avenue Extension and how many of Terr Maurer's

judgments were poor and the Council's decisions were also inappropriate, At this point, these
opinions will not do any good. The extension is in and has inappropriately become a permanent
"through" street. The safety of my family and also my neighbors is of utmost importance. This
street is currently not safe and just waiting for a tragic accident to occur!
So I get to my point of this email; I am formally requesting that the City Council approve the
addition of an all-way stop intersection at 193rd Avenue and Xavier St Nw. See the attached
petition request that is signed by seventy-nine X79} homeowners I residents within the
neighborhoods}, I had the pleasure over the last summer 1 fall to meet many nice neighbors
while collecting these signatures of support. Everyone asked unanimous support} was
agreeable to sign the petition.
I had originally spoken with all of you during an open Mike session on July 6, 2009. A memo
was then distributed by Terry Maurer on July 20, 2009 in response of the issues raised with the
Extension also attached}, As a follow-up, I had issued an email follow up and further points in
favor of my request email attached}.
I know and understand the points against an ail way stop intersection. I disagree with the
arguments because I feel like current safety risks knot to mention liability for the City} and
common sense should be enough to have the signs installed. As the Mayor states in a
response, "issues about safety and traffic and pedestrian flow will become clearer after the

street is fully opened". I agree; now that the Extension has opened, it confirms my original statements
in that pedestrians trying to cross at Xavier are having difficulty safely crossing, visibility from Xavier to
see vehicles coming from the West along 193rd Avenue is not favorable, and awareness for that stark of
a highly concentrated residential area is being neglected by vehicles traveling from the East along
193r~~ I believe that enough evidence and studies should have been gathered by now hover five
months later} to get these signs installed.
Please be assured that no one except maybe those who illegally speed through the neighborhood
habitually} will think that you are making the wrong decision.
1 will be following up with each one of yvu in the near term. I would ask that you discuss amongst
yourselves and thoroughly review this request. I also ask you to spend some time walking along the
sidewalk on the north side of 193rd Avenue someday between 4 and 6 pm. You will witness firsthand
how the neighborhood has been negatively affected by this Extension.

As requested, ~ have prepared this memo in response to an Open Mike appearance by Mx.
Aaron Rasmus who lives at the corner of Javier Street and ~ 93"~ Avenue in the woods at
Hillside Addition, Zt is my understanding that Mr. Rasmus raised two issues; the f~xst, being
speed li~xuts along the entire ~ 93`d Avenue corridor and the second, the need for an all-way
stop sign installation at the cornex• of Javier Street and 193`a Avenue. My comments on
these two issues areas follows:
.A, 193rd Avenue speed Li~nit~
The total length of i 93rd Avenue from TH ~ G9 to CSAH 13 Twin Lal~es Road} will be
approximately ~.5 miles, About half of the road currently exists through the Hillside
Estates and Moods at Hillside developments. This segment of ~ 93rd Avenue has a 30
mph speed limit and will remain unchanged after construction is complete. The half of
the corridor which is being newly constructed will need to have a speed study done by
MnD~T, As the Council is aware, the speed limits in the State of Minnesota are
determined by the state, either thxough a MnD~T speed study or thxough State Statute.
The State Legislature in the most recent session made some minor changes to traffic
statutes regarding speed limits in rural residential districts, however, a summary of that
law change produced by the League of Minnesota Cities, it does not appear that ~ 93rd
Avenue falls within that jurisdiction. zf it did, the new law change would allow a 35 mph
speed limit. Since it does not appear to fall within this new statutory def ninon of rural
residential district, MnDQT will be asked to perform a speed study, once the road is
complete..As Z have informed Mx. Rasmus and his wife in separate conversations, if
MnD~T comes bacl~ with a speed li~x~it of higher than 30 mph, city staff will mare a
recommendation to the City Council relative to a transition zone to make drivers aware
of the decreasing speed limit when traveling from east to west.

Until such time as a MnD~T speed study on the new portion of I93ra Avenue is
completed, our construction plans call for the entire corridor to be signed at 30 mph, so
that the corridor will not be open to traffic without a speed limit sign. If MnD~T
comes back with a higher speed limit on the eastern portion, the city will be required to
change the speed limit signs to the allowable speed indicated by MnD~T's study.
~. Stop Sign Installation ®I93ra Avenue/avier Street
The Minnesota Manual on Uniform Traffic Control Devices provides guidance for
multi-way or all-way stop sign applications, A copy of the information from the most
recent manual is attached, As you can see from this information, an all-way stop sign
installation is only typically warranted by vehicle traffic when it is at an intersection with
relatively equal traffic counts. This is certainly not the case at the intersection of ~aviet•
Street and I93ra Avenue. There is also guidance for installation based on traffic accident
history. But of course at this time, there is no traffic accident history of a type that
would be potentially elim~.n,ated by an all-way stop sign installation. Finally, under other
criteria that maybe considered is the issue of pedestrian/vehicle conflicts. At this point
in tithe, it is our opinion that the number of pedestrians utilizing the sidewalk on the
north side of 193rd Avenue from the Deerfield 3"~/Moods at Hillside neighborhood to
the south is not significant enough to warrant an all-way stop sign installation.
As I have told Mr. and Mrs, Rasmus in discussing this issue with them, we will monitor
the I93ra Avenue corridor as we do all new corridors relative to traffic volumes and
pedestrian usage. If either of these criteria rise to a level that we believe warrants an all-
waystop sign installation at Javier Street, we can easily male that recommendation to
the Council and install the additional stop signs at time.
Just for the Council's information, traffic control on I93ra Avenue is planned to be as
follows;
~ At Evans Street, the 3-legged stop situation on the 4-legged intersection will remain
in place but will be monitored closely, A fourth stop sign can easily be put i.n if it
becomes a problem. The geometries of construction for the new project will have
the intersection of Evans Street and I93ra Avenue completely constructed to accept a
signal system in the future.
® Auburn Street and I93ra Avenue will continue to have an all-way stop situation as
currently exists there.
® At Tyler Street and I93ra Avenue, the plans call for Tyler Street to a stop condition,
with I93ra Avenue not stopped. It is our feeling from traffic modeling that there will
be a much higher volume of traffic on I93ra Avenue than Tyler Street after
construction, thus the Tyler Street stop condition. Again, if the monitoring of the
new roadway after completion indicates an all-way stop installation is required, that
recommendation would be made to the City Council,
® At CSAH I3 Twin Lakes Road} and I93ra Avenue, there will be a stop sign on I93ra
Avenue and no traffic control along CSAH I3. This again, is based on traffic
volumes projected .into the future where CSAH I3 is anticipated to have a much
higher traffic volume than I93ra Avenue,

concerns associated with multiway stops include

Extension,
My wife and I have twa very young children, Daniel, who is 2 ~/z yrs old, and Katherine
Rose, who is ~ ~ months old.
~!e live on the corner of~avier St NW and 193r~ Avenue.
vve built our custom 2-story home 3 years ago in the summer Fall of 2006. Prior to the
purchase of the lot and prior to construction, there was no disclosure to the extent of the
street project ar sidewalk extension.
I am not going to go on today expressing my disappointment of the City Council's past
decisions made on these projects.

I am here tonight taking time away from my family on a couple of prudent, common
sense, and upcoming decisions thattheCity Council can make regarding the 193~a
Avenue Extension.
The first is the designation of a stop intersection.
The second is the posted speed limit along the newly constructed '193rd Avenue.
Let me start with the stop intersection. In reviewing the current design, talking with both
John Anderson and Terry i~auer, a 4^way stop is NAT currently planned for the
intersection of 193rd and Xavier.
Vl~e believe that this is a very critical location fora 4-way stop for the following reasons:
First of all, with the sidewalk extension and connection into the neighborhood to the
south, this is a heavily used pedestrian route, where people will frequently be crossing
193rd Avenue to get to the sidewalk to the north.
Secondly, is that the visibility with the changes in grade along 193rdand the curves near
the intersection are not favorable to even a 3omph limit in vehicularspeeds. V1le have
seen motorists speeding eastbound to the Xavier intersection in the winter miss the turn
and land up in the yard across on the east side of Xavier.
A vehicular to vehicular accident is eminent, especially with no stop sign.
realize that stop signs may not reduce overall speeds from Point A to ~, however, they
bring awareness to an intersection and planned pedestrian crossing.
don't care if they roll through the intersection~5} like they currently do from Xavier to
193rd Avenue, as long as they are made aware of the sto si n.

The safety of my children is the mast important factor, of course. Sure, they should not
be playing in the street or crossing without supervision, but you never know, An
emergency service, police or fire, was responding along 193rd Avenue lastweekwhen
the road contractor hit the gas line again near our home and ran over one of the
neighbor girl's cat. ~11ho knows, that could have been a child!
Another reason for the 4~way stag, for which is related to my next Council request, is
based on the traffic westbound from the new 4~way intersection.
vllith a fairly undeveloped and sparsely populated spattering of homes ~3-4} along this
new portion of 1 to 1 ~/~ miles, we know fihat the traffic will speed up beyond this
intersection and continue into fihis exisfiing residential development at a speed well over
the speed limit of 30 mph. wifih a stop sign designating the start of the development,
this will generally signal to this westbound traffic some awareness of this residential
area and 30 mph maximum Speed requirement.
This leads into my next item for a prudent and critical council decision and that has to
do with the eventual Speed limit of the new portion of City streefi extension. In talking
with Terry Mauer last Wednesday, he had indicated that the speed limit has nofi yet
been determined. He stated that once the road is open that the State DST will perform
some speed studies to determine their recommended limits.
Terry had suspected, based on his experience that it may be determined to be a 40
mph speed limifi due fio the boulevard only having one driveway l home along the route.
asked him whafi would be enforceable prior to fihe determination being made. He said
that he would have fio refer fio the Police Department.
l am asking tonight thafi the City forgo the speed study and make the responsible
decision to post this city boulevard permanently at 30 mph to match the speed limit
requirements in the residential area from Xavier Sfi NvU to Hwy 1 G9.
Again, without a 30 mph posting and a 4^way stop, I am very concerned about the
anticipated speeds coming and going through this residential area. I have counted
seventeen X17}driveways that enter on 193r~ Avenue, including ours. lfi will be very
dangerous for both vehicles and pedestrians along this raufie if traffic speeds exceed 30
mph.

For many of the affected residents in the neighborhood, I am compiling unanimous
support for these two ~2~ items regarding the ~ 93r~ Avenue extension through a signed
petition 1 formal request.
Although, I ask thatyou forgo the apinions of your Planning Commission, Public Works
Director, and City Engineer and make this sound, prudent, and responsible decision as
a City Council to immediately move forward with approval fora 4-way stop intersection
and 3D mph permanent posting.
Start tonight by listening to and acting on the majority otyour current constituents and
not developers, future constituents, and 1 or the surrounding communities.
All of you are here by elective vote from the citizens of Elk River; if these requests are
not seriously considered, this will be remembered when you come upfor re-election.
t don't expect a response ar feedback tonight, I will be following up with the Council
within the next month or less.
