Sherburne County ATV/Dirt Bike Ordinance
This is follow-up to my memo dated July 22, 2001, in regards to the ATV/Dirt Bike
Ordinance that was adopted by Sherbume County. As I indicated, I am providing you with
a copy of Sherbume County's new ordinance. Please review the ordinance and determine if
this is a subject we may want to address in our city.
Also, in yesterday's Star News (08-08-01) there was an article pertaining to this ordinance. I
have also attached this news story for you to read. It seems that the County Commissioners
may be re-evaluating some of the issues that have developed since the adoption of this
ordinance as a result of complaints from citizens.
After your evaluation, please advise if you wish to pursue this action in the City of Elk River.

Motorsport Facilites and tracks, previously covered under "Activities
Requiring Rural Isolation" - Private. Tracks and sites for dirt bikes, all terrain
vehicles, "mud tmcks'.'_,.race cars and similar vehicles.
A. The use of the facility is limited to the property owner and immediate family who reside
on the property.
B. The facility is not allowed in a residential plat..
C. The facility must be located on a minimum of 20 acres.
D. The Cotmty may limit the days and hours of operation.
E. The facility mUst be located a minimum of 1,000 feet from any residence except that of
the owner.
F. The facility must be located a minimum of 1,000 'feet from a livestock facility except that
of the owner.
G. Landowners wishing to hold a single day or week-end motor sport event or permit
holders wishing to schedule a special event in excess of their pennit limits may apply for
an "Occasional Special Events" Conditional Use Permit (Sec 16, Subd 2 26)
H. No more than two vehicles may operate at one time.
I. A 50 foot setback must be maintained from the track and property line.
This provision was passed by the Sherbume County Board of Commissioners on the l0th day of
July, 2001 and is duly filed with Sherbume County Auditor.
