August Park and Recreation Commission Update
Item # 5.3.
The Park and Recreation Commission had a full agenda for its August 8, 2001 meeting. In
addition to reviewing a number of land use cases for park dedication requirements, the
Commission took action on revised park names, the Youth Athletic Complex master
development plan and budget, and the revised snowmobile ordinance.

New Park Names
Earlier this year, the City Council approved the 2001 park expenditures as recommended by
the Commission. Included in this list of expenditures was money for a four-color park and
trail map, highlighting the City's recreational facilities. Staff and Commissioner Duane
Peterson have been working on the park and trail map and prior to publication, it was felt
that some of the park names needed to be changed in order to eliminate confusion and to
better differentiate park names, specifically, those that reflect residential subdivision names.
Attached please find a list of existing and proposed park names recommended by the
Commission for approval. Keeping with past policy, the Commission has avoided naming
parks after a specific person. Staff recommends that the Council concur with the
Commission's recommendation and accept the park names as attached.

Youth Athletic Complex Master Development Plan and Budget
Work to Date
Since June, staff has facilitated a number of meetings with the youth athletic associations and
has completed the following tasks:
1. Surveyed youth athletic coaches to determine priority of projects.
2. Developed two master plan alternatives.
3. Developed concession and shelter designs.
4. Developed a phasing plan and budget.
The most recent meeting with the associations occurred on July 30, 2001, and the
associations selected the attached master plan as the preferred alternative. This plan
provides a central concession area, detached restroom and storage building, eight sheltered
player benches and three spectator shelter areas that would hold six picnic tables each.
Bleachers are proposed along each of the eight sidelines and also behind each home plate.
At the Park and Recreation meeting of August 8th, it was suggested that shelters also be
included for the bleachers adjacent to the eight sidelines. The plan has been amended to
reflect this suggestion.
Budget Impact
The overall budget impact for the Youth Athletic Complex development is approximately
$615,000. This includes paving the driveways and parking lot, as well as providing a
playground structure ($180,000). The youth athletic associations have agreed to participate
in the development of YAC by organizing donations of time, material, labor and money in
order to supplement what the City can provide. It is staff's understanding that a member of
the association has obtained a set of lights from another athletic complex; however, at this
time this has not been confirmed. Lighting is proposed at $250,000. The remaining budget
would total $185,000.
Staff suggested and the Commission concurred, that the City provide funding in the amount
of $20,000 per year over 10 years towards the development of the Youth Athletic Complex.
Attached is the Park and Recreation 10-year capital improvements budget, showing the
impact of this dedication on the overall budget through the year 2010. The attached phasing
plan shows that construction should be completed by 2004-2005 is materials and labor can
be organized efficiently.
Action Requested
In order to begin construction, staff and the Commission are recommending that the
Council expend $12,500 in 2001 for the installation of the concrete for the batting cage,
bleacher pads, player bench pads, and also for the trenching of electrical and irrigation in the
areas where concrete will be located. It is staff's understanding that the youth athletic
associations will be in attendance at the August 20th meeting to present the City with their
last payment for Phase I of the Youth Athletic Complex development.

Staff recommends that the Council approve the Youth Athletic Complex
development plan, budget, and phasing plan, and that $12,500 be expended in 2001 to
begin construction of Phase 2 of the complex.
Revised Snowmobile Ordinance
Since May, staff has been working with Commissioner Dave Anderson and representatives
of the River City Snow Riders Snowmobile Club on revising the City's snowmobile
ordinance and identifying a trail for allowing snowmobilers to cross the City through the
Urban Service District safely. Phase 1 of the project, revising the snowmobile ordinance,
has been completed.
Attached for adoption is Ordinance No. 01-__, repealing the current snowmobile ordinance
and adopting the attached language. The revised ordinance establishes a definition for the
Urban Service District as that area south of 197th between the east and west corporate
boundaries south to the river boundary. The ordinance then establishes how snowmobiles
may be operated both inside and outside of the Urban Service District. Those that worked
on the revised language believe that the ordinance clearly spells out where snowmobiles are
permitted to ride.
The Police Chief and Assistant Police Chief have had an opportunity to review the revised
ordinance language and had no objection or concerns regarding the language. The
Commission voted unanimously to recommend adoption of the revised ordinance.
Staff will bring forward a revised snowmobile trail map for adoption by the Council at the
September meeting.
Staff recommends that the City Council adopt the revised snowmobile ordinance for
implementation in winter of 2001.

ORDINANCE 01 -
CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER REPEALING
ALL OF THE EXISTING SECTION 1104 OF THE CITY CODE OF ORDINANCES
AND ADOPTING A NEW SECTION 1104
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 1104 titled, SNOWMOBILES, of the City of Elk River Code of
Ordinances shall be repealed and a new Section 1104 shall be adopted as follows:
SECTION 1104 - SNOWMOBILES
1104.00 - APPLICABILITY
This ordinance applies to the operation of snowmobiles on public
lands and waters, and private property within the jurisdiction of
the City and on streets and highways within the boundaries of the
City.
1104.02 - DEFINITIONS
The words, combination of words, terms or phrases used in this
ordinance and defined in Minnesota Statutes, Section 84.81, shall
have the meanings given them by that section.
A. Urban Service District shall mean that part of the City
defined as the area south of 197th Avenue to the south corporate
boundary and between the east and west corporate boundaries.
1104.04 - ADOPTION OF STATE LAW BY REFERENCE
The provisions of Minnesota Statutes, Sections 84.82 pertaining
to registration, 84.87 pertaining to snowmobile operation and
regulations by municipalities, 84.871 pertaining to equipment
requirements, 84.872 pertaining to youthful snowmobile operators,
, 84.88 pertaining to penalties are adopted and made a part of
this ordinance as if set out in full.
1104.05 - OPERATION WITHIN THE CITY LIMITS
For defining where snowmobiles are permitted to operate, the City
has been divided into two parts:
a. Within the Urban Service District, and
b. Outside the Urban Service District.
A. Within the Urban Service District:
The operation of a snowmobile within the Urban Service
District is permitted:

On designated and marked snowmobile trails during
periods when trails are open
On public streets on the most right hand portion of
the roadway within the curb line or shoulder edge

and only when such operation is necessary to gain
access to or from designated trails, or areas,
which, by Minnesota Statutes, may be used by
snowmobiles. Such operation shall occur only
within the hours of 7:01 a.m. and 12:00 midnight
except for emergency purposes or except if the
operator is returning to his residence at a speed
not in excess of twenty (20) miles per hour.
In the bottom or outside slope of a ditch of County
Roads 12, 13, 30, or 35 or a state highway.
Over Lake Orono (when safely iced over), when
legally accessed as defined in this ordinance.
Over the Elk River (when safely iced over), when
legally accessed as defined in this ordinance.
On property you own.
B. Outside the Urban Service District:
The operation of a snowmobile outside the Urban Service
District is permitted:
i.)

v.)
On designated snowmobile trails.
In the bottom or outside slope of a ditch of County
Roads 1, 13, 21, 32 or 33 or a state highway.
On agricultural land that you have been given
permission from the landowner or occupant to ride.
On private property of another that you have been
given permission from the landowner or occupant to
ride.
On property you own.
Anywhere within the corporate limits of the City of Elk River,
snowmobiles shall not be operated:
o
On public lands, including but not limited to:
public parks, playgrounds, trails, sidewalks,
paths, open spaces, scenic and historic sites,
schools, golf courses, and other public buildings
and structures.
Within one hundred (100) feet of any fisherman,
fish house, shelter, pedestrian, skating rink,
sliding area or in any other area where such
operation would conflict with the use or endanger
other persons or property.
At any place, while under the influence of
intoxicating liquor, narcotics or habit-forming
drugs
At a rate of speed greater than reasonable or
proper under all the surrounding circumstances
At any place in a careless, reckless or negligent
manner so as to endanger the person or property
of another or to cause injury or damage thereto
In any tree nursery or planting in a manner which
damages or destroys growing stock

1104.06 - OPERATING REQUIRF~4ENTS
In order to operate a snowmobile lawfully within the City's
corporate limits, a snowmobile must have:
1.. A lighted headlight and taillight.
2.. A muffler in good working order which blends the exhaust
noise into the overall snowmobile noise and which is in constant
operation to prevent excessive or unusual noise.
3.. Without any noise-making device which amplifies noise
emitted from the snowmobile, including, but not limited to, tuned
exhausts cut-outs or straight pipes.
1104.08 - UNATTENDED SNOWMOBILES
It shall be unlawful for the owner or operator of a snowmobile to
leave a snowmobile in a public place without locking the
ignition, removing the key and keeping the same in his
possession.
1104.09 - PENALTY
Any person violating any provision of this ordinance shall be
guilty of a misdemeanor, and upon conviction thereof, shall be
punished by a fine of not more than $1,000.00 or by imprisonment
of not more than ninety (90) days, or both, plus costs of
prosecution in either case.
1104.10 - APPLICATION OF OTHER LAWS
The provisions of Minnesota Statutes, Chapter 169, pertaining to
traffic regulations, which relate to the use and operation of
snowmobiles, shall apply to the use and operation of snowmobiles
upon the streets and highways of the City. However, those
provisions which by their nature have no application shall not
apply.
Section 2. That this ordinance shall take effect upon publication as provided by law.
Passed and adopted by the City Council of the City of Elk River this 20th day of
August, 2001.
