Attachments Ordinance 95- August 22, 1995, Memo to the Planning Commission Background The City of Elk River is proposing an ordinance amendment to rear yard setbacks for principal structures (homes) in the Rlc (Single Family Residential) and Rlb (Single Family Residential) zoning districts. The existing rear yard setback in the Rlc zoning district is 10 feet, and the rear yard setback in the Rlb city-sewered areas is 15 feet, and non-sewered parcels 20 feet. Staff is proposing an ordinance amendment which would change the rear yard setback in the Rlc zoning district to 20 feet and Rlb zoning district to 25 feet. The attached memo to the Planning Commission explains this request in detail. Attachments • Ordinance 95- • Survey of other communities' rear yard setback Background The City of Elk River is proposing an ordinance amendment to rear yard setbacks for principal structures (homes) in the Rlc (Single Family Residential) and Rlb (Single Family Residential) zoning districts. The existing rear yard setback in the Rlc zoning district is 10 feet, and the rear yard setback in the Rlb city-severed areas is 15 feet, and non-severed parcels 20 feet. Staff is proposing an ordinance amendment which would change the rear yard setback in the Rlc and Rlb zoning districts to 25 feet. Analysis After researching various aspects of Elk River's ordinances, one potential problem that staff has been aware of is the rear yard setback in the Rlc and Rlb (Single Family) zoning district. As mentioned earlier, the existing rear yard setbacks vary from 10 feet to 15 feet in single family city-severed areas. Staff is concerned that if parcels are fully developed to the rear setback line, they may start to encroach on the privacy and comfort level of the parcels. OA95-13 Page 2 August 22, 1995 relaxing in the backyard and typically, most residents like to see some space • as a buffer to homes located behind their parcel. In a survey of other communities, Elk River had the smallest rear yard setback of all (see attached survey). Most cities require a rear yard setback between 20 and 30 feet. In our review of past single family building permits, rarely are homes located any where close to the 10 feet rear yard setback. Most meet a minimum of a 30 foot rear yard setback. Attached to your report is a drawing of the minimum size lot allowed in the Rlc zoning district (80' x 125' - 10,000 sq. ft. in size.) The sketch indicates that a 25 foot rear yard setback would not jeopardize the placement of a building or home on the property. In this example, a front yard setback in the Rlc zoning district is 30 feet. Atypical house is approximately 45 feet in width. Therefore, there still is a minimum of 50 feet from the rear of the home to the back property, which is ample room to construct a deck or 3-season porch, etc. and still meet the proposed 25 foot rear yard setback. Recommendation Staff recommends the Planning Commission recommend approval of the code amendment as proposed in the attached ordinance. • :7 s:plennin g;pc:oa95-13
