Location • Lot 8, Block 1, Elk River Industrial Park Zoning/Land Use I-1 (Light Industrial) / L-I (Light Industrial) Attachments • Updated Site Plan • Updated Landscape Plan • Drainage Plan • September 26, 1995 Memo to the Planning Commission Background Independent School District #728 is requesting a conditional use permit to construct a 21,000 square foot public works building in the Elk River Industrial Park. The site is currently owned by the City of Elk River Economic Development Authority. A hearing was held by the EDA on May 8, 1995 concerning the proposed sale of the property. It was the consensus of the EDA to proceed with the negotiations for sale of the property to the school district. A second meeting was held by the EDA concerning reviewing the site plan at the September 11, 1995 EDA meeting. Comments from the EDA 13065 Orono Parkway • P.O. Attached is a memo from Bill Rubin, Economic Development Coordinator, summarizing the EDA's position. The school district currently uses space in the City of Elk River's maintenance facility. Due to the increased space needs of the city public works department, the school district has been looking for additional space for the past few years. The attached memo the Planning Commission explains this request in detail. Updated Site Plan Independent School District #728 has submitted an updated site plan which does show some minor modifications from the Planning Commission meeting. The modifications include the extension of curb and gutter over the entire area with the exception of the south side of the parking area, due to the fact that this area maybe used for future expansion, and a minor alteration to the shape of the parking area to provide for greater turning radius'. The one significant change on the updated site plan is that the school district is requesting to use surmountable D4-12 curb instead of B612 barrier • curbing around the parking area and drives. Staff would recommend that B612 barrier curbing be used around the facility because it protects the landscaped areas from damage and may set a precedent for other requests in the future. Landscape Plan The applicant has modified the landscape plan slightly to address the concerns of the EDA related to additional screening of the loading docks from Industrial Boulevard by providing additional plantings along the berm near Industrial Boulevard. The school district has also added additional trees along the east side of the property to screen the use from Pomeroy Tool. Information was also provided regarding the tree size and species which are proposed to be planted. Drainage and Grading Plan A drainage and grading plan has been submitted to City Engineer Terry Maurer for review. Terry's comments maybe available for the City Council meeting. If this proposal is approved, staff would recommend that the drainage and grading plan be approved prior to issuance of a building • permit. s:councff:cu95-24 Planning Commission Meeting' • At the September 26, 1995 Planning Commission meeting, one resident, Dick Pomeroy, the owner of Pomeroy Tool which is located across Triangle Boulevard to the east, voiced his objection to the school district facility. His objections were the loss of tax revenue from a public building and the image of a public maintenance building in the Industrial Park which is currently occupied by light manufacturing users. Mr. Pomeroy was also concerned with the potential outdoor storage issue and requested additional trees be planted along the east property line to screen the use from his property. Ron Bratlie, representative of District #728, informed the Planning Commission that the School District would consider additional tree plantings on the east side of the site. The Planning Commission recommended approval of the request by District #728 with the conditions noted in staffs memo. The Planning Commission also included a ninth condition that additional screening be provided along Triangle Boulevard if feasible, to help screen the use from Pomeroy Tool. Recommendation Staff and the Planning Commission recommend approval of the conditional • use permit request to construct a 21,000 square foot public works building by Independent School District #728 with the following conditions: 1) A drainage and grading plan be reviewed and approved prior to issuance of a building permit. 2) An updated landscape plan indicating more plantings on the berm to screen the loading docks be prepared prior to the City Council meeting. The landscape plan should also include size and species of trees to be planted, location of underground irrigation, and sod and seed areas. 3) All concerns of the EDA be incorporated into the site plan. 4) The entire parking area and drives with the exception of the south side of the parking area be bound with B612 concrete curb and gutter. 5) A painted accent stripe or other decorative feature be considered around the entire building in order to give the building a more aesthetic appearance. • s:council:cu95-24 6) The location of a trash enclosure be identified on site. Due to the increased space needs of the city public works department, the school district has been looking for additional space for the past few years. Site Plan The site plan indicates a 150 foot by 140 foot (21,000 square feet) pre-cast concrete building proposed for the site. The building will be used for vehicle storage; maintenance, general storage and office space. The plan indicates two loading docks on the north side of the building closest to Industrial Boulevard and six overhead doors on the south side for vehicle storage and maintenance.. The site plan also indicates a large Northern Natural Gas easement near Industrial Boulevard. The school district is in the process of obtaining permission from the gas company to cross their gas easement. Parking and Drives The applicant is proposing to overlay the entire parking area and drives .with a bituminous surface. The entry drive to the warehouse dock and past the southeast corner of the building is shown to be bound with concrete curb and gutter as required by city code. The south side of the parking area does not show curb and gutter at this time due to the fact that this area may be used for future expansion. The employee parking lot on the east side of the site indicates 16 parking stalls. Elk River City Ordinance requires 19 parking stalls for a building of this size and use. The applicant has, however, demonstrated an additional 10 parking stalls which could be added if parking would become a problem on the south side of the parking area. Drainage and Grading The applicant has not yet provided a drainage and grading plan for this site. If this application is approved, a drainage and grading plan must be reviewed and approved prior to issuance of a building permit. • s:plannin g;pc:cu95-24 Landscaping' The proposed site plan indicates that the applicant proposes to plant a total of 20 coniferous trees, 22 deciduous trees and 20 ornamental trees. This plan would meet city code in terms of number of trees planted, however, more information needs to be provided as to size and species of the trees and the location of sod/seed. In an effort to try to screen the two loading docks on the north side of the building which face Industrial Boulevard, the applicant is proposing a landscape berm near the entrance of the site. The berm will extend from the entrance to the west side of the lot. If this proposal is approved, staff would suggest additional trees be planted along and near the gas line easement in order to better screen the loading docks from Industrial Boulevard. This will satisfy the EDA's concerns. The updated landscape plan should also indicate underground irrigation along Industrial Boulevard and Triangle Road, as it is required by city code. Architectural Standards The applicant has shown building elevations of a precast concrete building which meets Elk River City Code. Tf this proposal is approved, staff would recommend that a painted accent stripe or other decorative feature be considered around the entire building in order to give the building a greater • aesthetic appearance. Outdoor Storage The site plan indicates that the southern portion of the property may be used for future "yard storage". The school district has indicated that they have no plans for outdoor storage at this time. However, staff believes outdoor storage is imminent at this location at some point and time. If and when the school district has plans for outdoor storage, an approved screening and landscape plan should be reviewed by the staff to determine compliance with city code. Signage No signage plan was submitted with this request. Staff recommends that any free-standing sign be compatible with the proposed building. EDA Commissioners reviewed the check register and acknowledged its receipt. Consider a Request For Tax Increment Fnancing Assistance From Neos Inc Executive Director Bill Rubin acknowledged that the EDA is in receipt of a request for tax increment financing from Mr. Jack Mowry of Neos, Inc., 12797 Meadowvale Road. Mr. Mowry is proposing construction of a 16,000 square foot multi-tenant facility to be located in the McChesney Industrial Park. The Executive Director stated that Mr. Movdry is requesting TIF funds in the amount of $80,000, $60,000 of which would be used to write down the acquisition price of the lots in the industrial park and $20,000 which will be used for site preparation. Executive Director Bill Rubin stated that an Economic Development District would be established. He indicated that new TIF districts created by a city v~ll result in a loss of state aid. The EDA discussed the impact that a new TIF district would have on the city regarding the possible loss of state aid funds. Bill Rubin informed the EDA that the finished market value of the building is proposed to be $585,000.00. He further stated that when completed Neos, Inc. and the tenants in the facility would create sixteen new jobs and retain sixteen jobs. Bill Rubin discussed the need for a public hearing to discuss the terms and conditions of the sale of the property. COMMISSIONER DWYER MOVED THAT THE EDA UNDERTAKE THE FOLLOWING: • PREPARf A TIF PLAN FOR THE MOWRY/NEOS, INC. EXPANSION • SCHEDULE A PUBLIC HEARING FOR JUNE 12, 1995 TO CONSIDER THE ADOPTION OF THE TIF PLAN • AUTHORIZE A 90 DAY OPTION ON LOT 6 AND 7, MCCHESNEY INDUSTR[AL PARK • SCHEDULE A PUBLIC HEARING FOR JUNE 12, 1995 TO DISCUSS THE TERMS AND CONDITIONS BY WHICH LOT 6 AND 7 MCCHESNEY INDUSTRIAL PARK WOULD BE CONVEYED TO MOWRY/NEOS, INC. COMMISSIONER FARBER SECONDED THE MOTION. MOTION CARRIED 7-0. Public Hearina To Consider The Proposed Sale Of Lot 8 Block 1 Elk River Industrial Park To Independent School District 728 President Gongoll stated that he would abstain from a vote on this issue, due to his involvement v~th the school board. Pat Klaers, City Administrator, stated that the school board has directed Mr. Ron Bratlie to work v~th the city regarding the possible sale of Lot 8, Block 1, Elk River Industrial Park to the school district. He indicated that the school. district would use the property to construct a maintenance facility. •: President Gongoll opened the public hearing. economic Development Authorit}~ Minutes ;v:a~~ 8, ] Q95 Page 3 P.on Bratlie on behalf of the School Board presented the EDA v~ith a site drawing of the proposed facility. He informed the EDA that it is the intention of the school district to have no outside storage at the facility. The EDA indicated its concern regarding future expansion. Mr. Bratlie indicated that it is planned that this building v~ll meet the needs of the school district for at least ten years and that there has been room provided for expansion. Commissioner Hoimgren indicated his concerns regarding outside storage and. expansion of the site have been addressed. He indicated that he still has a concern regarding the use of this site for atax-exempt entity. Ron Bratlie indicated that space is limited for this type of facility. He further stated that the school district has searched other areas but felt that this site was best suited for the district's maintenance facility. There being no further comments, President Gongoll closed the public hearing. Commissioner Dwyer stated that he would support the sale of the industrial park property to the school district if the alternate site, located at the Oak Knoll fields, would remain as part of the Oak Knoll park and not be used by the school district for some other purpose in the future. Commissioner Farber indicated that the industrial park site is not a prime site due • to the wetlands. He further indicated his concern regarding the lack of recreational fields and stated that he would also prefer that the Oak Knoll park alternate site remain as park land. Commissioner Holmgren indicated that he concurred with Commissioner Dwyer, and Commissioner Farber regarding the Oak Knoll property. COMMISSIONER HOLMGREN MOVED TO PROCEED WITH THE NEGOTIATION OF THE SALE OF LOT 8, BLOCK 1, ELK RIVER INDUSTRIAL PARK TO THE SCHOOL DISTRICT AT A PRICE BETWEEN $37,500 to $45,000. COMMISSIONER DWYER SECONDED THE MOTION. MOTION CARRIED 6-0-1. PRESIDENT GONGOII ABSTAINED. 8. Update On The Citv's Review And Permitting Process Executive Director Bill Rubin informed the EDA that Training Networks, Inc. has submitted a revised proposal for facilitated planning, staff training, internal teamwork and information flow, as outlined in the needs assessment report. President Gongoll stated he supports the efforts and recommends that the City Council strongly consider approving the revised report. Commissioner Dwyer indicated that if this proposal is going to be successful, the City must move on to the next phase. Economic Development Authority Meeting September 11, 1995 - Page 2 6. Consider September EDA Rnancial Statement Assistant City Administrator, Lori Johnson submitted the statement of financial activity for the period ending August 31, 1995. As of that date, the micro-loan had a cash balance of $111,708, which also takes into consideration the $50,000 loan made to Custom Cutter Grinding. As of August 31, 1995 the block grant micro-loan fund had a cash balance of $42,883. The cash balance of the EDA due to a repayment of funds from the youth hockey association, was $50,701. 10. Review and Comment on a Conditional Use Permit Requested by School District No. 728 ILot 8, Block 1, Elk River Industrial Parkl President Gongoll stated that he will act as a facilitator but will abstain from any decisions on this issue, due to his involvement with the school board. Bill Rubin informed the EDA that District 728 has applied for a conditional use permit and would construct a 21,000 square foot maintenance facility on Lot 8, Block 1, Elk River Industrial Park. Commissioner Dwyer had concerns that landscaping should cover the dock doors. Commissioner Duitsman supported the use of berming. Bill Rubin informed the EDA that the dock is considered a depressed dock, so there is a minimal opportunity for a vehicle to be there for any long period of time. However, sufficient berming in the front yard is needed. The site plan also indicated a storage yard near the rear portion of the lot. The • School District considers this an element that will be undertaken in the future. Outside storage is permitted in industrial areas as long as it is screened. The consensus was to authorized Bill Rubin, Executive Director, to communicate concerns and comments of the Economic Development Authority to the Planning Commission's public hearing on September 26, 1995 and to the City Council on October 2, 1995. 11. Other Business 11.1 Presentation and Update from ECM Publishers, Inc. Pat Klaers, City Administrator, introduced Jeff Athmann, President, and Bob Cole, Marketing Manager, of ECM Publishers, Inc.. ECM Publishers, Inc. is proposing the acquisition and renovation of the former County Administration Building at U. S. Highway 10 and King Ave. Jeff Athmann, and Bob Cole explained ECM's goals and needs for. building and parking. The current need is 16,000 square feet; future needs would require a 30,000 square foot facility, and possibly, 45,000 square feet. At some point ECM would need 60,000 square feet. EL_ K RIVER.. MEMORANDUM TO: Elk River Planning Commission FROM: William Rubin, EDA Executive Direct DATE: September 26, 1995 SUBJECT: District No. ?28 CUP Request (Lot 8, Block 1, Elk River Industrial Park) As the current property owner of the above-referenced site, the EIk River Economic Development Authority (EDA) reviewed the conditional use permit (CUP) request from District No. 728 at its meeting on September 11, 1995. Two issues were identified by the EDA and are outlined as follows:. . A. Dock Doors Located at the Front of the Buildin City staff had hoped that District 728 would relocate the dock doors to the rear part of the maintenance facility. However, representatives from the school district tried unsuccessfully to accomplish this and the current floor plan dictates that the dock doors be in the front. That being the case, EDA Commissioners fully support a berm in the front yard to help screen. the dock doors. In addition, it was also learned that the dock doors have a depressed area. and there is m;n;mal opportunity for trucks to be parked at the dock doors for long periods of time. B. Storage Yard The EDA was assured by representatives of the school district that the storage yard is not proposed: at this time. While the EDA recognizes that outside storage is permitted in a light industrial area, it also needs to be screened from view.- Should the'district choose to designate a storage yard in the future, it is expected that they will work with city staff to develop a screening system that is consistent. with the intent of the zoning ordinance. • P.O.
