SUBJECT: Petition to Abandon a Portion of
County Ditch #10
The recently completed storm sewer project at Evans and Main makes a
portion of County Ditch #10 unnecessary. The attached map shows the
portion of County Ditch #10 which no longer serves a useful function.
Because the city's new storm water system is separate from the county ditch
in this area, the county ditch should be eliminated versus the city taking it
over using the recently passed special legislation. Staff recommends the city,
as a property owner in this area, petition the County Board to abandon that
portion of County Ditch #10 in question. Attached to this memo is a petition
for abandonment.
It is anticipated that the County Board would accept the city's petition at
their November 7 county ditch meeting and set a public hearing on this issue
for their December 5 county ditch meeting. Staff will be in attendance at the
public hearing.

Current law requires the Sherburne County Ditch Authority
to set a date to hear your petition and the Auditor to
publish the notice three consecutive times in the official
county newspaper. Other Property owners on the county ditCH
may attend the hearing and voice their opinions for or
against the granting of your petition.
Yaur petition can be granted by the Ditch Authority only
with the following findings of fact:

diverted from the drainage systemeoryahdam hasn
been lawfully constructed and the property cannot
use the drainage system.
x The property is not benefitted by the drainage
system and does not use or affect tha drainage
