Overview
The proposed preliminary plat involves creating a 3 acre parcel along with
dedication of appropriate right-of--way for the extension of a public road south
of Business Center Drive with the balance of the property left in an outlot
status. The preliminary and final plat are consistent with a concept plan
that was presented to the Planning Commission and City Council when
Country Crossing Business Center 1st Addition was platted earlier this year.
The minimum lot size in the Business Park zoning district is 1-1/2 acres. The
• proposed parcel of 3 acres exceeds the minimum lot size requirements
satisfies applicable standards. This preliminary and final plat is being

processed to accommodate a prospective manufacturing company that would
like to locate in Elk River. This manufacturing company is proposing to
construct initially a 17,000 square foot building with the ability to expand to
roughly 30,000 square feet at a later date.
Right-of--Way South of Business Center Drive
The developer is platting enough right-of--way to accommodate access to the
new parcel. The concept plan presented previously to the City Council
illustrated a cul-de-sac extending south of Business Center Drive. This cul-
de-sac provided no access to 183rd Avenue. The developer may or may not
plat and construct all of this cul-de-sac as part of this plat. Whether the
entire cul-de-sac is completed with this plat or deferred to the next phase,
enough right-of--way will be platted and street built to serve the proposed
plat.
Preliminary and Final Plat
The City's subdivision ordinance allows for the opportunity to process the
preliminary and final plat on a concurrent schedule. This may happen in
those situations where the plat is creating a few lots and has very few issues
associated with it. Staff believes the proposed plat fits those criteria;
therefore, has brought both the preliminary and final plat before the City
Council at this time.
Planning Commission Recommendation
The Planning Commission recommended approval of the preliminary plat as
proposed by DMV Mall Corporation with the conditions outlined in the staff
report.
Recommendation
It is recommended the City Council approve the following:
a) Preliminary plat to subdivide approximately 20 acres into one
industrial lot and one outlot with the conditions stated in the staff
report.
b) Resolution 95- ,granting final plat approval for Country Crossing
Business Center 2nd Addition with the conditions outlined in Exhibit
B.

RESOLUTION NO. 95 -
CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR
COUNTRY CROSSING BUSINESS CENTER SECOND ADDITION
CASE NO. P 94-14
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on October 16. 1995; and
• WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C. The physical characteristics of the site, including ,but not limited
• to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
D. The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. .The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse
impact on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.

A developer's agreement be prepared and executed, outling the terms
and conditions of plat approval and installation of public utilities.
2. All comments in Terry Maurer's memo dated 9/19/95 be incorporated for
approval of the preliminary plat and final plat.
3. A storm drainage impact fee in the amount of $741.60 per acre be paid
prior to release of final plat for recording. This fee does not apply to that
.portion of the plat referred to as Outlot A.
4. A water availability charge be paid to Elk River Utilities in the amount of
$300 per lot prior to release of final plat for recording.
5. The final plat be revised to include the extension of the appropriate
drainage and utility easements to allow the extension and looping of
public utilities.
6. A complete grading plan for the business park be submitted to the City
Engineer for review and approval.
7. Prior to releasing the final plat for recording, the developer pay all
oustanding bills pertaining to this proposed plat.

Overview
The proposed preliminary plat involves the creation of one 3-acre parcel and
the extension of a public road to serve additional lots in the Country Crossing
Business Center. The preliminary plat is consistent with a concept plan that
was presented to the Planning Commission and City Council when the first
addition was platted earlier this year. As mentioned above, the proposed
parcel will be three acres in size which exceeds the m;n;mum lot size
requirement in. the business p ark zoning district.

• The city and developers of the business park have recently been working
with a manufacturing company that would like to locate in the new business
park. This manufacturing company is proposing to construct originally
17,000 square feet with the ability to expand to 30,000 at a later date. Given
this size building and associated parking, a three acre site is being created.
Outlot A
Outlot A is an area that will be need to be replatted in the future at the time
of further development interest. With the extension of the cul-de-sac south of
Business Center Drive, additional lots could be created from Outlot A. As
discussed with the original plat for Country Crossing. Business Center, any
re-subdivison of Outlot A will not allow access onto 183rd Street immediately
to the south.
Extension of Cul-de-Sac
Although the plat doesn't indicate the complete extension of .the cul=de-sac
south of Business Center Drive, the developers are considering completing
this road immediately. In order to do this the plat would be modified to
include an additional 200 feet of right-of--way south of where it currently
terminates.
Utilities
Please refer to the City Engineer's memo dated 9/19/95.
Recommendation
It is recommended the Planning Commission recommend approval of the
proposed preliminary plat by DMV Mall Corporation to create a three acre
parcel along with Outlot A with the following conditions:
1. A developer's agreement be prepared and executed, outlining the
terms and conditions of plat approval and installation of public
utilities.
2. All comments in Terry Maurer's memo dated 9/19/95 be incorporated

RE: COUNTRY CROSSING BUSINESS CENTER, SECOND ADDITION
Dear Mr. Ach:
As you requested, we have reviewed the preliminary plat of Country Crossing Business
Center, Second Addition. Based on our review, we would offer the following comments..
The plat was prepared by John Oliver and Associates, and includes one lot at the
northwest corner with the remainder of the site between Business Center Drive and
183rd as an outlot.
2. We would recommend that the cul-de-sac be continued and the entire right-of--way
platted with this particular addition. That will eliminate the need for building a
.temporary cul-de-sac and building the road in two different segments. The road
itself we would recommend be a minimum of 36 feet wide, anticipating some larger
vehicles accessing the businesses.
Provisions were made with the first phase of the Business Center development for
utilities to be extended into this phase. There is sanitary sewer and water service
stubbed from Business Center Drive to the proposed Lot 1 of this development.
There is also sanitary sewer and water stubbed from Business Center Drive in the
location of the road for extension down to serve the other lots. The watermain
should be looped to 183rd where there were also provisions made. for an 8-inch stub
to be connected to the existing watermain in 183rd Avenue.
4. A determination will need to be made regarding how this proposed development fits
into the overall drainage plan for the Country Crossings Business Center. As you
recall, there were a series of ponds built with the First Addition. The question is
do these ponds have enough capacity for the proposed Lot 1, or do the future ponds
planned for south of Business Center Drive need to be constructed.

5. As this site develops, we would like to limit the amount of accesses onto Business
Center Drive, and would prefer that the access from this site be from the cul-de-sac.
