Mr. Anderson is requesting an administrative subdivision to divide Outlot A
of the Brentwood Subdivision into two separate lots which will measure 8.4
acres in size respectively.

Dennis Anderson is requesting an administrative subdivision to divide
Outlot A of the Brentwood Subdivision into two separate buildable lots.
Outlot A is currently 16.8 acres in size. The subdivision would involve
subdividing the outlot into two parcels, both of which would measure 8.4
acres in size. The property is currently vacant and is zoned Rlc, single
family residential which has a minimum lot size of 10,000 square feet and 80
feet in width. Both proposed parcels will well exceed this minimum
standard.
History
This spring, Mr. Anderson proposed to rezone and change the land use of
• Outlot A from single family residential to highway commercial. This request

was withdrawn by the applicant on June 15, 1995. Concerns by staff and the
• City Council on the rezoning issues related to intensity of the use with the
close proximity of residentially zoned property, transportation issues, and the
fact that the city had not identified this area as a commerciaUindustrial
growth area.
Dimensional Regulations
Outlot A of the Brentwood Subdivision is a relatively flat, open parcel with
very few trees. The minimum lot size in the Rlc zoning district is 10,000
square feet with 80 feet of frontage. Each parcel is well over the minimum
lot size of 10,000 square feet and, therefore, should meet the intent of the
subdivision regulations. The applicant is limited to what the property can be
used for until city sewer and water is available to the site. Therefore,
development of this area into single family homes or another use allowed in
the R1c zoning district will not be allowed until the extension of city services
to this area is complete. If this request is approved, staff would request an
additional 14' of right-of--way for a total of 80' along 197th Avenue NW. The
addition right-of--way would be necessary for road/intersection improvements
to 197th Avenue and Highway 169. Staff would also request a 10' drainage
and utility easement bounding the entire plat including the newly created lot
line.
• Park and Recreation Commission
At the last Park and Recreation meeting, the Commission recommended a
cash payment of $500 per parcel be paid for park dedication purposes. The
Park and Recreation Commission also requested that if a portion of the
property is ever rezoned for a commercial use that the commercial park
dedication fee be applied for that area. If the site is ever further subdivided
for additional residential lots, park dedication will be a requirement for the
newly created parcels.
Surface Water Management Impact Fee
A surface water management impact fee in the amount of $123.60 should be
required on both parcels as a condition of approval. This fee must be paid
prior to recording the subdivision with Sherburne County.
Recommendation
Staff recommends approval of the administrative subdivision request by
Dennis Anderson to divide Outlot A of the Brentwood Subdivision into two
• separate parcels measuring 8.4 acres in size with the following conditions:
1. Park Dedication fees of $500 be paid for both Parcel A and Parcel B. If
• the property is ever rezoned for a commercial use, commercial park
dedication fees as required by the City at that time be required on the
subject property. Credit will be given for the residential rate paid as
part of this subdivision.
2. A Surface Water Management Impact Fee of $123.60 be paid for both
Parcel A and Parcel B prior to recording.
3. An additional 14 feet of right-of--way be provided along 197th Avenue.
An easement document shall be prepared and executed prior to
releasing the administrative subdivision for recording.
4. A 10 foot drainage and utility easement be added around the entire
plat including the newly created lot line.
