Staff recommends that the Planning Commission recommend approval of the Conditional Use Permit
request, as illustrated on drawings dated 3/31/10, with the following conditions:
1. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
require permits.
2. Sign permits will be required for any signage.
3. The applicant shall obtain all required licensing from the State of Minnesota prior to
operation.

Requested Action Conditional Use Permit for a Childcare Facility
60 Day Rule The City must take action by May 30, 2010
Location and Size Approximately 3.75 acres near the southeast corner of Highway 169 and
193`d Avenue.
Overview
The applicant is requesting Conditional Use Permit (CUP) to operate a childcare facility at the
subject property. They currently operate a childcare facility in the same multi-tenant building and
are at full enrollment in that space. They are looking at expanding and want to move the school age
children to the new space which is not directly attached to the existing space.
The hours of operation will be 6 a.m. to 6:30 p.m. Monday through Friday and they will employ
approximately three staff members at the new location in addition to the 21 people currently
employed at our current location.
Although they are not proposing signage at this time, they would in the future like to have a sign
that is approximately 24 square feet in size which meets the signage allowances. A sign permit will
be required for any exterior signage.
Transportation
The vehicular circulation has already been reviewed and approved for the subject site. There is
adequate vehicular circulation in and around the site. The overall parking was taken into account
when the existing project was built and there appears to be sufficient area for the proposed use.
Comprehensive Plan
The Highway Business land use is the most intensive form of commercial development in Elk River.
Businesses in this category may be the largest both in terms of size and traffic generation. Market
orientation tends to be regional in nature. Development orientation tends to be toward regional
highways. Future Highway Business developments should be located within the Urban Service
Boundary and adjacent to regional highways. The proposed use meets these requirements.

Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
~. Wlill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate
vicinity or the public health, safety, morals, comfort, convenience orgeneral avelfare of the neighborhood or the
~iy.
2. lYlill be consistent with the comprehensive plan.
3. 1-Vill not impede the normal and orderly development and improvement of surrounding vacant property.

4. bill be served adequately by and avill not adversely affect essential public facilities and services including
streets, police and fzre protection, drainage, refuse disposal, avater and Seaver systems, parks and schools; and
will not, in particular, create tra~c congestion or interference with traffic on adjacent and neighboring public
thoroughfares.
5. 1-Vill not involve uses, activities, processes, materials, equipment and conditions of operation that will be
detrimental to any persons orpropery because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. 1~ill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
7. 1,Vill fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license or permit to establish and operate the proposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all
of these standards.

To whom it may concern,
We at Learning Blocks Childcare, LLC are currently at full enrollment at our existing location and are
looking to expand our program to meet the needs of our clients and community. Our plan is to move our
school age children into the new space allowing our center to expand by approximately 36 children. By
making this move we will be capable of meeting the needs of our current families with school age
children or the children that will become school age as of the fall of 2010. Without this addition we will
not have the capacity to meet the needs of our soon to be school age families in addition to the families
that are currently enrolled in our school age program.
We are licensed for 116 children. Of these children 30 of the spaces are for school age. Our school age
program is full with no openings in the near future. We have 19 families that will have children entering
Kindergarten in the fall of 2010. By moving our school age program to the new location within the same
strip mall, will allow us to continue to provide childcare for all of our families. We would open the
current school age classroom for Kindergarten and older preschool children.
At our current position we will not have a preschool opening for a minimum of three years. With this
move we will be capable of adding an additional preschool space for childcare and an AM and PM
preschool program. On a weekly basis we are turning away three to four families looking for preschool
care or class time. We would open our school age program in the new location for AM and PM preschool
time on days that the school age children have school.
The scope of the project will entail
• conditional use permit for zoning the new location for childcare
• Addition of two toilets with one new bathroom added
• Addition and moving of a total of three sinks
• General cleaning and painting of walls
• No Ea'terior Construction is necessary
Our hours of operation will be 6 AM to 6:30 PM Monday thru Friday
We will be employing approximately three staff members at the new location in addition to the 21 people
currently employed at our current location.

building in channel letters to fit the space of approximately twelve feet by two feet on the front of the
building.
As per our conversations with Chris at the Elk River planning department we have omitted a proposed
screening site or outdoor storage because it is not applicable to our request.
