Request by Sprint for Conditional Use Permit for Antenna Tower, Public Hearin -Case No. CU 10-10 Action Requested Staff recommends approval of the Zone Change request, as illustrated on drawings dated April 15, 2010. Staff recommends approval of the Conditional Use permit, as illustrated on drawings dated March 22, 2010, with the following conditions 1-11: Prior to Building permit: 1. The tower must be designed to accommodate two additional users. 30-1837 d-(2) 2. Towers and their antennas shall be certified by a qualified and licensed professional engineer to conform to the latest structural standards and wind loading requirements of the Uniform Building Code and the Electronics Industry Association and all other applicable reviewing agencies. 30-1837 a-(2) 3. Engineered fall zone analysis shall be conducted by a qualified structural engineer. This report shall specify in writing that any collapse of the tower would occur within a specified fall zone within a lesser distance than the setback. Section 30-1837 h-(5) 4. All signal and remote control conductors of low energy extending substantially horizontally above the ground between a tower or antenna and a structure, or between towers, shall be at least eight feet above the ground at all points, unless buried underground. 30-1837 a-(5) 5. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all require permits. 6. The development shall meet all applicable fire codes. The Fire Chief shall verify the location of all fire hydrants, and may require additional hydrants necessary to preserve the health and safety of the residents. Ongoing: 7. All towers shall be protected against unauthorized climbing. The bottom of the tower (measured from ground level to 12 feet above ground level) shall be constructed in such a manner to preclude unauthorized climbing. The tower, antenna and supporting equipment shall be enclosed by an eight-foot-high chain link fence with a locked gate. 30-1837 a-(6) Case File: CU 10-10 ZC 10-04 Page 2 Sprint Cell tower Sportsman Club 8. Metal towers shall be constructed of, or treated with, corrosive resistant material. 30- 1837 e-(7) 9. Only one tower shall exist at any one time on any lot or parcel. The minimum lot size requirement shall be one acre. 30-1837 a-(8) 10. Towers and antennas shall be designed to blend into the surrounding environment through the use of building materials, color, textures, camouflaging architectural treatment, screening and landscaping, except in instances where the color is dictated by federal or state authorities such as the Federal Aviation Administration. 30-1837 f- (1) 11. No advertising, logos or identification of any kind is permitted, except as may be required by federal and state authorities. 30-1837 g Background/Discussion Cellular communication towers are regulated by Section 30-1837 of the City Code. That section includes requirements that telecommunication towers are permitted as a conditional use in the AT overlay zone. An application has been received to cover both land use requests. Overview The applicant is requesting zoning approval to install a 150' tall telecommunications tower on property owned by the St Louis Park Sportsman Club. The applicant proposed to lease a 900- square foot portion of the property. This portion would be zoned AT (overlaying the existing and remaining R-1a). Improvements to the site proposed by Sprint include the monopole tower and ground mounted equipment. The proposed tower will be located 330 feet from the nearest property to the south. It is proposed to be 430 feet from the property to the west. The tower will be visible form adjacent properties, but will within the height requirements of the zoning ordinance. However, these units will not be visible from any public streets or from adjacent property. Because of these issues, Staff supports a waiver of this requirement. Applicable Regulations Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 7. Weill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the city. 2. lYlill be consistent with the comprehensive plan. 3. mill not impede the normal and orderly development and improvement of surrounding vacantproperty. 4. Weill be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer ystems, parks and schools; and will not, in particular, create tra~c congestion or interference with tra~c on adjacent and neighboring public thoroughfares. 5. Weill not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons orproperty because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Weill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. i-Vill fully comply avith all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. In the review of the standards for CUP as outlined, it appears that the request is consistent with all of these standards. Ke~onang In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly affected by the proposal, the conservation of proper y values, the use to which the property affected is being devoted at the time, and relevant provisions, if any, in the land use plan. In addition to the rezoning standard above, the Planning Commission and Council must consider the following criteria with reviewing a rezoning to AT: 30-1837 (b) Findings. In order to accommodate the communication needs of residents and businesses while protecting the public health, safety, andgeneral welfare, the czty council finds these regulations necessary in order to: (1) Establish standards which permit a reasonable and equitable opportunity for the establishment of wireless telecommunication service in the city. (2) Avoid potential damage to adjacent properties from tower failure through structural standard and setback requirements. (4) Maximise the use of existing and approved towers, buildings and other structures to accommoa'ate new wireless telecommunication antennas in order to reduce the number of towers needed to serve the community. In staff s opinion, the applicant satisfies these requirements: 2) Following conditions proposed by staff, damage to adjacent properties should be avoided. 3) Minimizing adverse visual impacts does not suggest that there will zero visual impact. The applicant has taken pains to locate the tower into the property, and at a height less than the maximum permitted. 4) The applicant has maximized the use of existing towers. This site is the fourth proposed in Elk River; all others are onto existing water towers. As part of this project Sprint is proposing to construct a 150' monopole communications tower on property owned by The Elk River Sportsman's Club located at 20309 Meadowvale Road, Elk River MN 55330. There are no existing towers or tall structures anywhere in this area that would allow us the opportunity to collocate on an existing structure and this area is currently experiencing very poor cellular coverage. This site was chosen as the landowner owns over 300 acres and we will be able to site the tower a considerable distance from the nearest residence. Our objective is to be able to provide uninterrupted cellular coverage for Sprints customers within a 3 to 5 mile radius of the proposed tower. In addition to the tower, Sprint will be placing communication equipment on a platform at the base of the tower. This tower will be designed to accommodate up to three tenants. There will be no advertising on the tower. Once the tower is constructed, vehicles will visit the site for maintenance purposes approximately once a month. The proposed Facility will be unmanned, and it will operate continuously. No sewer or water service is required for operation of the tower. As part of this process, City code requires that we request to rezone the specific parcel that the tower will be sited on to "Antenna Tower Overlay District". This letter will serve as this request. Enclosed with this letter, I am providing, the CUP Application, the Zone Change Application, 4 copies of zoning drawings, 4 copies of a completed survey, a copy of the tax statement to identify the parcel, a CD with the drawings, survey, and copy of this letter on it, the required mailing labels, and the required fees.
