Staff and the Planning Commission recommends approval of the Conditional Use permit, as illustrated
on drawings dated March 22, 2010, with the following conditions 1-11:
Prior to Building Permit:
1. The tower must be designed to accommodate two additional users. 30-1837 d-(2).
2. Towers and their antennas shall be certified by a qualified and licensed professional
engineer to conform to the latest structural standards and wind loading requirements
of the Uniform Building Code and the Electronics Industry Association and all other
applicable reviewing agencies. 30-1837 e-(2).
3. Engineered fall zone analysis shall be conducted by a qualified structural engineer.
This report shall specify in writing that any collapse of the tower would occur within
a specified fall zone within a lesser distance than the setback. Section 30-1837 h-(5).
4. All signal and remote control conductors of low energy extending substantially
horizontally above the ground between a tower or antenna and a structure, or
between towers, shall be at least eight feet above the ground at all points, unless
buried underground. 30-1837 a-(5).
5. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
required permits.
6. The development shall meet all applicable fire codes. The Fire Chief shall verify the
location of all fire hydrants, and may require additional hydrants necessary to
preserve the health and safety of the residents.
Ongoing:
7. All towers shall be protected against unauthorized climbing. The bottom of the tower
(measured from ground level to 12 feet above ground level) shall be constructed in
such a manner to preclude unauthorized climbing. The tower, antenna and

supporting equipment shall be enclosed by an eight-foot-high chain link fence with a
locked gate. 30-1837 a-(6).
8. Metal towers shall be constructed of, or treated with, corrosive resistant material. 30-
1837 e-(7).
9. Only one tower shall exist at any one time on any lot or parcel. The minimum lot size
requirement shall be one acre. 30-1837 a-(8).
10. Towers and antennas shall be designed to blend into the surrounding environment
through the use of building materials, color, textures, camouflaging architectural
treatment, screening and landscaping, except in instances where the color is dictated
by federal or state authorities such as the Federal Aviation Administration. 30-1837 f-
(1).
11. No advertising, logos or identification of any kind is permitted, except as may be
required by federal and state authorities. 30-1837 g.
Summary
Sprint is requesting permission to construct a 150' tall telecommunications tower on a portion of the
property owned by the St Louis Park Sportsman's Club, in Elk River. City ordinance requires
telecommunication towers only be located in AT overlay zones.
To change the zoning to include AT zone, the ordinance includes additional criteria. These criteria
include:
30-1837 (b) Findings. In order to accommodate the communication needs of residents and businesses while
protecting the public health, safety, and general welfare, the city council finds these regulations necessary in
order to:
(7) Establish standards whichpermit a reasonable and equitable opportunity for the establishment of
wireless telecommunication service in the city.
(2) Avoid potential damage to adjacent properties from tower failure through structural standards and
setback requirements.
(3) Minimise adverse visual ~ects of towers through careful design and siting standards which attempt to
screen and/ or camouflage towers and antennas from adjacent private and public properly.
(4) Maximise the use of existing and approved towers, buildings and other structures to accommodate new
winless telecommunication antennas in order to reduce the number of towers needed to serve the community.
It appears that the criteria are satisfied, due to the tower's location, its height, and its design.
In addition to the rezoning, a conditional use permit is required. With the conditions as proposed, Staff
feels as though the criteria necessary to grant a CUP are satisfied.
Planning Commission Discussion
The Planning Commission questioned whether the entire sportsman club property will be rezoned. Only
the lease area will be rezoned.
Public Comment
No public comment was received. After the meeting, the applicant asked that the attached email be
forwarded to the Council. The Applicant would request that conditions #3 and #12 be removed.
Condition #3 requires a fall zone analysis be completed that states that should the tower fall, it would fall
in a specific location, and within a lesser distance than the setback. The nearest property line is 330 feet

away. Should the tower tip completely over, the nearest it could be to a neighboring property is 180 feet,
outside the minimum setback.
Condition #12 requires all components to be housed in a structure. The intent is to provide housing for
the cabinets that are more visually pleasing than random cabinet of varying shapes and sizes. The
proposal shows these cabinets located away from the nearest street, and adequately screened. Staff
supports the removal of the conditions.

Background/Discussion
Cellular communication towers are regulated by Section 30-1837 of the City Code. That section includes
requirements that telecommunication towers are permitted as a conditional use in the AT overlay zone.
An application has been received to cover both land use requests.

Location and Size A portion of approximately 40 acres north of County Rd 32, west of
Coun Rd 1.
Overview
The applicant is requesting zoning approval to install a 150' tall telecommunications tower on
property owned by the St Louis Park Sportsman Club. The applicant proposed to lease a 900-
square foot portion of the property. This portion would be zoned AT (overlaying the existing and
remaining R-1a). Improvements to the site proposed by Sprint include the monopole tower and
ground mounted equipment.
The proposed tower will be located 330 feet from the nearest property to the south. It is proposed
to be 430 feet from the property to the west. The tower will be visible form adjacent properties, but
will within the height requirements of the zoning ordinance.

The ground mounted equipment will not be located within a structure, as required by City Code
section 30-1837 h (1) and (2). However, these units will not be `~isible from any public streets or
from adjacent property. Because of these issues, Staff supports a waiver of this requirement.

The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:

findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all
of these standards.

In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and
indirectly affected by the proposal, the conservation of prnper y values, the use to which the properly affected is being
devoted at the time, and relevant provisions, if any, in the land use plan.
In addition to the rezoning standard above, the Planning Commission and Council must consider
the following criteria with reviewing a rezoning to AT:

In staff's opinion, the applicant satisfies these requirements:
2) Following conditions proposed by staff, damage to adjacent properties should be avoided.
3) Minimizing adverse visual impacts does not suggest that there will zero visual impact. The
applicant has taken pains to locate the tower into the property, and at a height less than the
maximum permitted.
4) The applicant has maximized the use of existing towers. This site is the fourth proposed in Elk
River; all others are onto existing water towers.

Sprint wireless is trying to improve their cellular coverage in the Elk River area. As
part of this project Sprint is proposing to construct a 150' monopole
communications tower on property owned by The Elk River Sportsman's Club
located at 20309 Meadowvale Road, Elk River MN 55330. There are no existing
towers or tall structures anywhere in this area that would allow us the opportunity
to collocate on an existing structure and this area is currently experiencing very
poor cellular coverage. This site was chosen as the landowner owns over 300 acres
and we will be able to site the tower a considerable distance from the nearest
residence. Our objective is to be able to provide uninterrupted cellular coverage for
Sprints customers within a 3 to 5 mile radius of the proposed tower. In addition to
the tower, Sprint will be placing communication equipment on a platform at the
base of the tower. This tower will be designed to accommodate up to three tenants.
There will be no advertising on the tower. Once the tower is constructed, vehicles
will visit the site for maintenance purposes approximately once a month. The
proposed Facility will be unmanned, and it will operate continuously. No sewer or
water service is required for operation of the tower. As part of this process, City
code requires that we request to rezone the specific parcel that the tower will be
sited on to "Antenna Tower Overlay District". This letter will serve as this request.
Enclosed with this letter, I am providing, the CUP Application, the Zone Change
Application, 4 copies of zoning drawings, 4 copies of a completed survey, a copy of
the tax statement to identify the parcel, a CD with the drawings, survey, and copy of

Jeremy,
Per our conversation earlier today, it was my oversight to not mention Sprints request to not be
bound by your current zoning ordinance requiring a "Fall Zone Letter" (item 3 in staff report) and
requirement for all ground equipment to be housed within a structure (item 12 in staff report)
below at the Planning Commission meeting last night.
3. Engineered fall zone analysis shall be conducted by a qualified structural engineer.
This report shall specify in writing that any collapse of the tower would occur within
a specified fall zone within a lesser distance than the setback. Section 30-1837 h-(5)
12. All accessory equipment related to towers and antennas must be housed within a
structure, to be constructed of compatible materials, including wood, brick, or
stucco. 30-1837 h (1) and (2)
Because of where the tower will be located, approximately 330 feet from the closest property line,
even if the entire tower were to fall, it would remain within the land owner's property which would
defeat the purpose of requiring a fall zone letter which are normally required only in cases where
the tower is set back less than the height of the tower from property lines and some form of
assurance is needed to show that the tower would collapse in half in the extremely unlikely even
the tower were to fall over. Also, because the area we will be locating the tower is heavily
wooded, the ground equipment will not be visible from any neighboring parcels and barely visible
on only the north side to the landowner. Sprint utilizes outdoor equipment cabinets for their
equipment, not a shelter and as such their equipment is designed to be housed in outdoor
cabinets. Since the site is hidden from view, we ask that we be allowed to use equipment cabinets
at this site.

AN ORDINANCE AMENDING THE
CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTIES
TO AT (ANTENNA OVERLAY)
CASE NO. ZC 10- 04
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone to AT the properties described as:
See Attached Exhibit A
Section 2. The rezoning is being approved based on the following findings:
1. THE PROPOSED REZONING IS COMPATIBLE WITH THE
SURROUNDING LAND USES.
2. THE PROPOSED REZONING IS NECESSARY IN ORDER TO PROVIDE
EFFECTIVE WIRELESS TELECOMMUNICATION COVERAGE FOR THE
CITY.
3. THE REZONING IS IN ACCORDANCE WITH THE COMPREHENSIVE
PLAN FOR THE CITY.
Section 3. That this Ordinance shall take effect and be in full force from and
after the date of its publication.

CONDITIONAL USE
The above entitled matter came to be heard before the City Council on the 17 May 2010, on
a petition for a Conditional Use pursuant to the City of Elk River Zoning Ordinance, for the
following described property:

IT IS ORDERED that a Conditional Use be granted as upon the following conditions or reasons:
Prior to Building permit:
1. The tower must be designed to accommodate two additional users. 30-1837
d-(2)
2. Towers and their antennas shall be certified by a qualified and licensed
professional engineer to conform to the latest structural standards and wind
loading requirements of the Uniform Building Code and the Electronics
Industry Association and all other applicable reviewing agencies. 30-1837 a-(2)
3. Engineered fall zone analysis shall be conducted by a qualified structural
engineer. This report shall specify in writing that any collapse of the tower

4. All signal and remote control conductors of low energy extending
substantially horizontally above the ground between a tower or antenna and a
structure, or between towers, shall be at least eight feet above the ground at
all points, unless buried underground. 30-1837 a-(5)
5. As a Conditional Use Permit is not a Building Permit, the applicant shall
apply for all require permits.
6. The development shall meet all applicable fire codes. The Fire Chief shall
verify the location of all fire hydrants, and may require additional hydrants
necessary to preserve the health and safety of the residents.
Ongoing:
7. All towers shall be protected against unauthorized climbing. The bottom of
the tower (measured from ground level to 12 feet above ground level} shall be
constructed in such a manner to preclude unauthorized climbing. The tower,
antenna and supporting equipment shall be enclosed by an eight-foot-high
chain link fence with a locked gate. 30-1837 a-(6)
8. Metal towers shall be constructed of, or treated with, corrosive resistant
material. 30-1837 a-(7)
9. Only one tower shall exist at any one time on any lot or parcel. The minimum
lot size requirement shall be one acre. 30-1837 a-(8)
10. Towers and antennas shall be designed to blend into the surrounding
environment through the use of building materials, color, textures,
camouflaging architectural treatment, screening and landscaping, except in
instances where the color is dictated by federal or state authorities such as the
Federal Aviation Administration. 30-1837 f-(1)
11. No advertising, logos or identification of any kind is permitted, except as may
be required by federal and state authorities. 30-1837 g

If the proposed work described in a conditional use permit has not been substantially
completed within two (2) years after its date of issuance, the permit shall expire and become void
except that the Council may, following recommendations of the Planning Commission, extend the
permit for an additional period determined by the council on the receipt of a request for a permit
extension prior to its expiration. A Conditional Use permit authorizes only the use specified in the
permit and shall expire if, for any reason, the authorized use ceases for more than one (1) year.
